CONDITION OF SALE
<p>1.KIeselbach Gallery and Auctions House (auctioneer) organises and conducts a public auction at the auctioneer's own expense in order to sell the objects listed in this catalogue either offered by the vendors or the auctioneer's own possession. The auction is organised, handled and conducted by the auctioneer, acting as a trading agent on behalf of the vendor. The conditions of sale are included in the catalogue which is available at the exhibition or at the scene of the auction.
<p>2. The lots called up are presented in succession in the catalogue. The auctioneer announces the catalogue number of the lot and buyers indicate their wish to bid by raising their hand.
<p>3. The highest bidder acknowledged by the auctioneer shall be the buyer at the hammer price. However, in case of protected lots marked "VÉDETT" (protected) in the catalogue.
<p>4. Hungarian museums are entitled to buy the item at hammer price. On behalf of the commissioning party and in capacity of agent thereof, the Auctions House is fully authorised to enter into an agreement of sale with the highest bidder and to receive the purchase price on behalf of, and to the benefit of, the commisioning party and the buyer. The buyer shall pay the purchase price in cash immediately after the sale or pay.
<p>5. 20% of the purchase price in deposit. Credit cards are subjected to a 3% commission. The bought item can be handed over to the buyer on condition that the total purchase price is fully paid up in one lump after the sale. The indicated put-up price is without tax, fees and costs.
<p>6.The Auctions House allows a 10 day grace period to pay the residual amount after the deposit has been provided. (Address: 1055 Budapest, Szent István krt.) In such cases the buyer may only enter into possession of the item when the full purchase price has been paid up within 10 days from the auction. The amount of the deposit will be included in the purchase price if the said timeline has been observed.
<p>7. The Auctions House reserves the right to consider the bid of the purchaser null and void and keep the deposit if the buyer fails to take over the item within the timeline hereunder.
<p>8.The buyer shall pay an agency fee of 20% of the hammer price.
<p>9.The buyer shall transport the item purchased at his own risk and cost immediately after the purchase price has been paid. Failure to do so will release the Auctions House who will not be liable for any loss or damage. Further, the Auctions House will charge a monthly 5% storage fee after the 20th day from the auction. If the buyer fails to take away the goods within 6 months from the auction, the Auctions House will call on the buyer to do so. In case of noncompliance the Auctions House will be free to sell the item, deduct its costs and expenses and keep the residual amount to and for the benefit of buyer.
<p>10.The bid item may not be reauctioned unless the identity of the buyer is impossible to estabilish.
<p>11. No seller may bid, nor may any third party bid on seller's behalf in order to reach an unreasonably high price and thus inflict loss on any other party. No prior collusion or agreement is allowed to impact the course of the auction. Parties may not share or promise any gains resulting from such collusion or otherwise.
<p>12. All the lots are exhibited for inspection prior to and after the sale. All goods are sold without warranty with all the imperfections they may have at the time of the sale. Descriptions and illustrations in the catalogue are for identification only. Buyers shall satisfy themselves prior to the sale as to the order and condition of each lot and shall rely on their own judgement as to wether the lot accords with its own description. In case of orders to buy of the same amount the Auction House favours the order to buy which is received earlier.
<p>13. In case the identity of the buyer and the vendor is the same, the contract of the sale shall not be concluded. However, the bidder shall pay agency fee determined below.
<p>14. The Auctions House will not accept any complaints after the lot has been knocked down unless the item is not genuine despite being so marked in the catalogue. In such case the buyer may file a complaint in accordance with the Civil Code of Hungary. The court responsible is: Fovárosi Bíróság.
<p>15. The items auctioned may not be sold under the estimate price in the catalogue. The Auctions House will not bear any liability in respect of the bid or the purchase price paid. The Auctions House may not be compelled to reoffer the same item or market it at any time. If the vendor is not qualified as inlander under the Foreign Exchanges Act on the basis of the hungarian provisions of law, for the validity of the contract between the vendor and the auctioneer who became the buyer after the knocking-down, is necessary the permission of the foreign exchange authority. Obtaining the above mentioned permission is the vendor's duty. The Auctions House handles the lot and the paid purchase price by the buyer as a deposit, and only after the permission hands them over the person entitled thereto.
<p>16. For absentee bids the auctioneer may be commissioned by the buyer to bid on his/her behalf. You may submit your bid personally in the Kieselbach Gallery from 10 a.m to 6 p.m. every day before the auction. If it is not possible, for a satisfactory service it is strongly recommended that you submit your bids at least 24 hours prior to auction. Please fax us at: +36-1-269-2219. An advance payment of 50% of the bid shall be transferred which will be refunded if the bid fails to succeed. You may also bid over the phone, which requires that a bank guarantee be attached. In case of identical bids the earlier will take precedence. <p>17. No item marked "VÉDETT" (protected) may be taken outside of Hungary. Owner of protected lots will be registered by the museum. In case of any change in ownership the museum shall immediately be notified.
<p>18. If the sold item is exported, 3% of the purchase price will be charged for the export license.
<p>19. Unsold goods may be reauctioned after the sale upon request.
<p>20. To assist the sale all prospective buyers are kindly requested to use their bidding paddle.
