1. (a) Persons bidding at the sale, together with persons bidding by commission, will be deemed, by the Auctioneers, to agree with these conditions of business.
(b) The Auctioneers act as Agents only.
(c) Particular attention should be paid to the paragraph headed "2 Descriptions" below.
2. DESCRIPTIONS
(a) The descriptions in this catalogue are an expression of opinion only, and NO warranty whatsoever is given or implied. There is, in general, no reference to the condition of lots in the catalogue. A number of items may be damaged and/or defective. Purchasers must, therefore, satisfy themselves as to the authenticity and condition of all items in each lot PRIOR TO BIDDING.
(b) Any references in this catalogue are for assistance only and in no way indicate that items without such references are perfect.
(c) Any queries regarding lots purchased at this sale must be made to the Auctioneers within 3 working days subsequent to the sale date (or in the case of commission bids, within 5 working days, subsequent to the sale date).
3. All lots sold are subject to reserve.
4. The highest bidder to be the purchaser, and should any dispute arise the lot so disputed shall be immediately put up again and resold to the highest bidder thereafter.
5. A 15% Buyers Premium together with 17.5% V.A.T on the premium will be charged on all lots purchased.
6. The purchaser shall if required deposit 25% on the purchase price immediately on the lot being knocked down to them. The lots shall be paid in full on the sale day and removed at the buyers risk and expense at the conclusion of the sale or within two days thereafter.
7. Commission purchases must be paid for within five days of the sale regardless of whether the lots have been collected. Title to goods shall not pass to the Purchaser until they are paid.
8. PAYMENT
No delivery of goods will be given until payment has been made in full by cash, certified cheque, bankers draft or cheque within the limit of a valid cheque card. Cheques exceeding the limit of a valid cheque card must be cleared at the bank before delivery of goods can be given.
9. DELIVERY
(a) A receipted account must be handed to the Auctioneer's sale porter before any delivery can be effected.
(b) All lots purchased are at the risk of the Purchaser from the fall of the hammer.
10. The Auctioneers reserve the right to group together, divide, withdraw or alter the order of the sale of any lots notwithstanding the catalogue arrangement, also to refuse the bids of any person they may deem objectionable.
11. Failing compliance with the above conditions or any of them, defaulters lots may be resold by public sale or private bargain as the Auctioneers think fit without further notice than is hereby given and all loss and expense attending such resale shall be made good by the defaulter at this Sale.
12. The Auctioneers decision on all disputes at or in any way referring to the Sale, or the interpretation of these conditions shall be final and binding on all parties concerned.
13. PHOTOGRAPHS AND ILLUSTRATIONS
The seller grants to the Auctioneers full and absolute right to photograph and illustrate any individual lot placed in their hands for sale and to use such photographs and illustrations at any time at their absolute discretion whether in connection with the particular auction sale at which the lot is exposed or otherwise.
14. SELLERS
(a) The Seller warrants to the Auctioneer that the seller has authority to sell all items entered for sale and that no item entered by them is a deliberate forgery or is the subject of substantial concealed alteration or repair of which they should have knowledge.
(b) The Seller is deemed to have authorised the Auctioneers to deduct their commission and charges from the sale proceeds.
(c) A Charge of 1% of the hammer price is made to the Seller for the provision of insurance cover for the items whilst in the custody of the Auctioneers, such items being fully covered to a maximum of their net auction value.
