Conditions of Sale
1. Bidding
1.01 The highest bidder shall be the buyer.
1.02 The Auctioneer will regulate the bidding.
1.03 The Auctioneer may refuse any bid without giving any reason.
1.04 If there is a dispute between bidders the Auctioneers have the unfettered right either to determine the dispute or to re-offer the lot.
1.05 The Auctioneers may bid on their own account or as agents for others
1.06 The seller may bid in person or by agent.
2. Payment
2.01 The buyer shall pay the full price and VAT if applicable within the time limit stated in the auction catalogue.
2.02 Payment in cash is preferred. Cheques will only be accepted if covered by a valid cheque card or if prior arrangements have been made with the Auctioneers accounts department.
2.03 In default of due payment the Auctioneers may without notice to the buyers rescind the sale and re-offer the lot and recover the amount of any loss and expenses on resale from the defaulter.
2.04 Payment will only be accepted from the successful bidder.
2.05 The buyer shall pay to the Auctioneers a premium of 15% of the "Hammer Price" inclusive of VAT and agrees that the Auctioneers, when acting as agent for the seller, may also receive a commission from the seller.
3. Collection
3.01 No lot may be removed until the buyer has paid the full price thereof and of all other lots purchased by him or any other sum due by him to the Auctioneers
3.02 Subject to proof of payment by production of a receipted account the buyer shall remove all lots no later than the time limit stated in the catalogue.
3.03 If any lot has not been removed by the time limit stated in the catalogue regardless of whether or not it has been paid for the Auctioneers may without notice to the buyer rescind the sale and re-offer the lot and recover the amount of any loss and expenses on resale from the buyer. Alternatively the Auctioneers may remove and store the lot in which case the buyer shall by liable to pay the Auctioneers their reasonable charges for removal and warehousing.
4. Claims
4.01 The Auctioneers will consider claims that a lot does not correspond to the description as to genuineness or authenticity provided that the buyer returns the lot to the Auctioneers and makes the claim not later than noon of the fifth day after the sale.
4.02 The Auctioneers will consider claims that a lot does not correspond to description as to quantity or mechanical condition provided that the buyer make the claim before the lot is removed from the Auctioneers premises.
4.03 Subject to Clause 4.01 and 4.02 above all lots are sold with all faults and errors of description.
4.04 A buyer is expected to inspect before bidding a must rely on such inspection. A bidder for domestic appliances, hotel catering or office equipment, plant, machinery, vehicles and all other power driven items should satisfy himself before bidding by inspection whether or not the lot is suitable for the purpose for which he is buying it and complies with all applicable legislation and regulations. A buyer who has not inspected before bidding bids at his own risk.
4.05 The liability of the Auctioneers and the seller is respect of any claim established by the buyer shall be limited to repayment of the purchase price against return of the lot in respect of which the claim arose.
5. Availability
5.01 After the fall of the hammer whether through errors in lotting up or any other cause any lot or part thereof is not available the Auctioneers may without notice to the buyers rescind the sale without liability to the buyer.
6. Risk and Title
6.01 On the fall of the hammer risk passes to the buyer.
6.02 Title shall not pass until lots have been paid for and collected.
7. Auctioneers as Agents
7.01 The Auctioneers act as agents only for the seller and shall not be liable for any default by the seller.
8. Breakages
8.01 The Auctioneers reserve the right to charge for all breakages.
9. Testing
9.01 All testing of lots is done at the risk of the prospective bidder who should ensure that he has suitable qualified independent advice if need by

10.01 All goods sold are second hand unless otherwise stated.

Special Conditions of Sale
VIEWING On the preceding Saturday between 9.30am and 1pm; Monday between 9.30am and 7.00pm; and on Days of Auction from 9am. Viewing outside these times is only by prior arrangement with the Auctioneers.
COMMISSION BIDS Bids may be left with the Auctioneers for which forms are provided. ALL BIDS ARE TREATED IN THE STRICTEST CONFIDENCE. Lots will be bought as cheaply as is allowed by other bids and reserves. Successful bidders will be advised by telephone the day after the Auction.
BIDDING RATE We aim to sell between 120 and 140 lots per hour.
V.A.T. All lots marked VAT = Y are being sold on behalf of vendors who are registered for Value Added Tax, i.e. V.A.T. at the current rate will be added to the hammer price and a V.A.T. receipt will be issued. We operate under the V.A.T. MARGIN SCHEME. Any V.A.T. registered purchaser requiring a full V.A.T. invoice (i.e. non margin scheme) PLEASE ADVISE OUR ACCOUNTS DEPARTMENT OR THE AUCTIONEER ON THE DAY OF THE SALE. We are unable to provide altered Invoices at a later date.
BUYERS PREMIUM The Buyer shall pay the Auctioneers a premium of 15% on the hammer price, inclusive of Value Added Tax at the current rate on the premium. A V.A.T. receipt will be issued.
ESTIMATES The estimates provided are the approximate prices we expect to be realised. They are not definitive.

PAYMENT Payment by cash is preferred. Debit and Credit Cards are accepted (Switch, Delta, Visa, MasterCard), a charge of 2% will be added for payment by Credit Card. Cheques will only be accepted if presented with a valid cheque card or if prior arrangements have been made with our Accounts Department. No goods will be released until cheques have been cleared. To avoid delay please make arrangements prior to commencement of the Auction. Payment in full must be made before 5.00pm on the Friday following the Auction.
COLLECTION All lots must be paid for and collected by 5.00pm on the Friday following the Auction unless prior arrangements have been made with the Auctioneers.
CARD BIDDING A card bidding system will be in operation for this Auction. Prospective purchases must register with the Auctioneer's Clerk on the morning of the Auction. The Auctioneers reserve the right not to accept bids from a person who is not registered.
