1838 Texas land oath signed by Justice Edwin O. Legrand, signer of the Texas Declaration of Independence and Constitution, and Texas patriots Alexander Horton, Ezekiel W. Cullen and Nathaniel Hunt. Signed oath prescribed by the Republic of Texas Constitution in which the signer, Sebastian Garner, swears “that I did not leave the Country during the campaign of the Spring of 1836 to avoid a participation in the struggle [Alamo, San Jacinto, etc.]…did not refuse to participate in the War…did not aid or assist the enemy…am entitled, under the Constitution and laws, to the quantity of land, for which I now apply…” Datelined Republic of Texas, County of St. Augustine, 18 February 1838. Partly printed document signed “A. Horton,” “N. Hunt,” and “Sebastian C. Garner,” on front and “E.W. Cullen,” “E.O. Legrand,” and “Thos H. Garner'' on verso. The Constitution of the Republic of Texas of 17 March 1836, provided that “All persons who shall leave the country for the purpose of evading a participation in the present struggle, or shall refuse to participate in it, or shall give aid or assistance to the present enemy, shall forfeit all rights of citizenship, and such lands as they may hold in the republic…” thereby requiring an oath such as this for land ownership. Single page measures 7.5” x 5”. Lightly foxed and soiled. Uneven upper edge. Very good condition.
