"Tom Mooney 31921" on his illustrated letterhead showing him before and after his "frame-up", 3pp. 4to., "County Jail No. 1", San Francisco, Mar. 17, 1937 to attorney John Finerty. In small part: "...I think that the Justices of the California Supreme Court have their minds made up and will unquestionably vote against granting our writ of habeas corpus...nothing either of you say...will affect their final decision...Our one and only aim at this time is to get the matter out of the California Supreme Court...you appearance here would positively arouse the most bitter antagonism. You are generally hated by both Cleary and Mitchell...hoping the court will permit me to remain here in the county jail while the matter is being prepared for the United States Supreme Court...if I could secure an unconditional pardon from this body I would accept it...I may even make a drive on the President of the United States...a number of Senators are jointly preparing to sponsor a commutation...[they are] terribly fearful of my denouncing any effort...[to] commute my sentence to time served...".
