CONDITIONS OF SALE
</b>
1. The auction is organized, handled and conducted by the auctioneer, Detre & Ferenczy Antikvitás, acting as an agent on behalf of the vendor. The lots celled up are in succession as in the catalogue. The auctioneer announces the catalogue number of the lot in question and buyers indicate their wish to bid by raising their hand.
2. The buyer offering the highest bid shall acquire the title of the lot. In the case of items marked in the catalogue "protected" /VÉDETT/ all Hungarian museum have priority to purchase the lot at the hammer price. /1997. CXL TVP on the protection of national heritage.
3. 3. The Detre & Ferenczy Antikvitás as a commercial agent is authorised by the commissioning party to sign the sale and the purchase agreement of the lot with the highest bidder and receive the purchase price on behalf of and to the benefit of the commissioning party.
Under this arrangement the sale and purchase agreement shall be settled by the commissioning party/owner of the lot and the buyer.
4. The buyer shall pay a deposit of 20% of the hammer price in cash upon the successful bid. In case the full purchase price is paid in one amount after the auction the buyer can take immediate possession of the object.
The commercial agent allows a three day period from the date of the auction for the payment of the balance amount between the deposit and the full purchase price. The purchase price includes the amount of the deposit provided the deadline set for the balance payment has been met. The commercial agent reserves the right to terminate the sale and purchase agreement unilaterally if the purchase price has not been paid in full by the set deadline. In this case the paid up deposit shall not be refunded to the buyer.
5. In case of paintings, the buyer is obliged to pay up to HUF 500.000,- the knock down price plus its 20%, and above a knock down price of HUF 500.000,- the knock down price plus its 15%.
In case of any other article, the purchase price amounts - irrespective of the knock down price - to the knock down price plus its 15%.
In case of transfer of the ownership right of an original work of the fine arts or the applied arts (paintings, drawings, picture graphics provided with a serial number and the signature of the artist, as well as works of the applied arts and goblins), the buyer is obliged to pay together with the purchase price also an author's royalty amounting to 5% of the purchase price (Law No. LXXVI of 1999.), as well as a cultural contribution amounting to 1% of the purchase price (Law No. XXIII of 1993.)
The commercial agent is obliged to collect and transfer the author's royalty and the cultural contribution.
6. Immediately after sale the buyer assumes responsibility for the lot including any loss or damage and for shipment thereof.
The auctioneer is not responsible for any damage occuring after the sale. If the buyer fails to ship the bought item the auctioneer has the right to charge 5% of the price as storage price per mounth from the five day of the date of the auction. In case the buyer fails to ship the goods - in spite of being called upon to do so - after 6 months the agent as the right to sell the item and will preserve the amount for the buyer as deposit minus expenses.
7. Once awarded to the highest bidder, the item may not be repurchased and auctioned again, unless the identity of the buyer cannot be established. In this case the Auctioneer is entitled to reauction the item.
8. All collussion or conspiracy on behalf of any part planning to force a third party to make an unreasonably high bid, and thus inflict any loss on the third party is strictly forbidden.
9. All goods are sold with all faults and imperfections and errors of description. Illustrations in the catalogue are for identification only.
Buyers should satisfy themselves prior to the sale as to the condition of each lot and should exercise and rely on their own judgement as to whether the lot accords with its description.
No objections may be taken into consideration after knocking down, except if the article is false, although it is indicated in the catalog as a genuine one. The auction buyer is in such a case entitled to enforce his claim in a way and within a period of time stipulated in the Civil Code.
10. The article to be put up for auction cannot be sold below its upset price.The purchase price shall be established as a result of the auction, according to the bids of the participants. The commercial agent does not assume in this respect any responsibility.
11. In case a buyer does not wish to participate in the auction personally, commercial agent may represent him, in accordance with a purchase assignment issued by the buyer. The Client is obliged to hand over 50% of the amount stipulated in the purchase assignment as a down-payment to commercial agent, against a certificate of receipt.
In case a third party issued a purchase assignment of a higher amount for the same article or an auction buyer offered a higher bid, or an auction price were offered a price identical with the auction limit of the client, the down-payment shall be returned to the client after the auction without any deduction, againt the certification of receipt of the purchase assignment.
The commercial agent also provides the perticipants with the possibility of submitting their bids by telephone and by internet.
12. No objects marked "VÉDETT" (protected) in the catalogue may be taken abroad. Owners of protected goods will be registered by museums which should be notified in the case of any change in ownership.
13. Unsold items may be reauctioned at the end of the auction upon request to the commercial agent.
14. If the purchase item is going to be exported, there is a value depending export-license fee to be charged in addition.
15. Credit Cards may be accepted at the sale. Subject to an additional 3% charge.
16. The Detre & Ferenczy Antikvitás garanties that all the sold lots are genuine.
