Hardy presided over many of the mining cases on the Comstock including the Potosi Gold & Silver Mining Co. versus The Bajazet & Golden Era Gold and Silver Mining Company in 1864. The great California legal orator Henry Edgerton along with William Higby and Alexander Campbell prosecuted Judge James H. Hardy, on his impeachment trial before the California State Senate in 1862. The accused Judge was removed from office and moved on to the Comstock in the Nevada Territory. (History of the bench and bar of California: edited by Oscar Tully Shuck 1901, p.570). James H. Hardy had been judge of the district court of the sixteenth judicial district of California. Hardy, was a self-made man and had considerable ability as a lawyer and politician. However, he an extremely vocal advocate of the South. One of his main achievements in the judicial office was to preside in the trial of Terry for the killing of Broderick in the famous duel. He ruled on that trial for Terry's acquittal. That verdict, unpopular with many, in addition to his habit of publicly using noisy secession language, induced the assembly of 1862 to present to the senate articles of impeachment against him. California courts required members practicing law there to take a loyalty oath resulting in many great legal minds fleeing to the nearby Nevada Territory for sanctuary including Judge Hardy and A. P.
