DS, two pages, 8.5 x 11, November 22, 1937. Permission statement regarding a prior photoplay contract, in part: “I hereby warrant to you that I am the duly appointed administratrix…of George Gershwin…and that I am his sole heir-at-law…and I will be entitled to receive distribution of the whole of his estate…I agree that that any and all provisions of that certain contract dated December 3, 1936, between you and George Gershwin and Ira Gershwin…shall be and the same hereby waived to the extent necessary to permit the use…in connection with said photoplay of songs and/or musical material composed by Vernon Duke…and to permit…in any act or sequence of the Ritz Brothers in connection with said photoplay.” Signed at the conclusion in fountain pen by Rose Gershwin, and countersigned by Samuel Goldwyn Vice President David E. Rose. In fine condition, with a horizontal fold and rust mark along top edge. Dated just four months after Gershwin’s untimely death, this document is in reference to the 1938 film The Goldwyn Follies, Gershwin’s final film score which Victor Duke was commissioned to finish before its release. Gershwin received a posthumous Oscar nomination for the score.
