Autograph manuscript of General Order No. 9, dated April 10, 1865, in pencil, written by Confederate Captain James Mitchel, who signs at the conclusion, “R. E. Lee, General,” on an off-white 5 x 8 vertically-lined sheet. Mitchel writes: “After four years of arduous service, marked by unsurpassed courage and fortitude, the Army of Northern Virginia has been compelled to yield to overwhelming numbers and resources. I need not tell the survivors of so many hard fought battles who have remained stead fast to the last that I have consented to this result from no distrust of them – But feeling that valor and devotion could accomplish nothing that could compensate for the loss that would have attended the continuance of the contest, I determined to avoid the useless sacrifice of those whose past services have endeared them to their countrymen. By the terms of the surrender, officers and men can return to their homes and remain until exchanged – You may take with you the satisfaction that proceeds from the consciousness of duty faithfully performed and I earnestly pray that a merciful God will extend to you his blessing and protection. With an unceasing admiration of your constancy and devotion to your country and a grateful remembrance of your kind and generous conduct to myself, I bid you an affectionate farewell.” Also included is a muster roll, signed by Mitchel, 21.5 x 21, for Mitchel’s Company (‘C’) of the First Regiment of Virginia Volunteers, Army of the Confederate States of America,…“from the 28th day of February 1862, when last mustered, to the 30th day of April 1862.” A list of 12 officers and 69 privates. Mitchel has signed on the first line “James Mitchel Captain [enlisted] 21 April [1861] Richmond [by] Capt Jno Dooley [for] 1 year Assigned to Company 26th of April 1862 Capt English ret.” It’s interesting to note that 2nd Lieutenant John Sullivan “deserted on the 16th day of April 1862.” Mitchel has signed again on the reverse certifying the accuracy of the muster roll. Manuscript bears two horizontal folds, scattered light toning and soiling, and a few portions of the manuscript light, but still completely legible, otherwise fine condition. Muster roll rates good to very good, with tape repairs to fold separations, a few unrepaired partial separations, uniform toning, and fragile folds. Mitchel’s signature “Lee” resembles Gen. Lee’s “Lee” which suggests that Capt. Mitchel copied it from one of those orders Gen. Lee signed.
