Numismatic Auctions LLC - Terms Of Sale
1. Bids by mail, email phone or fax will be also be accepted as well as through Icollector.com until the designated cutoff time. All phone bids must be confirmed in writing on a signed bid sheet. Bids are treated as LIMITS. Bids are reduced where competition permits. In the case of tie bids the first bid is given preference. No “buy” or unlimited bids are accepted. Bids are accepted by lot number only. No lots are broken up. Bids are only accepted in even dollar amounts.
2. This sale is NOT an approval sale. All material offered is guaranteed genuine and as described. Careful examination and descriptions have been made for every lot. Cataloging errors will be promptly corrected and refunded. FLOOR BIDDERS MANY RETURN ANY LOTS including those purchased as agents. All claims for returns or adjustment must be made within 5 days of receipt but in no case more than 35 days after the sale. As the auction house acts as an agent for various consignors, NO CLAIM OF ANY KIND can be considered after settlements have been made. If a claim is not made within a thirty day time period, no lots are returnable for any reason at any time. If we are notified prior to our settlement date that an issue of authenticity is in question, the matter will remain open until an entity such as PCGS or NGC can render an opinion. Lots are not shipped until paid in full. Therefore, late payment will negate a return privilege. Third party graded or certified coins are non-refundable and cannot be returned. Grading is subjective and our grading is only an opinion, not a guarantee of condition when submitted to a third party service. Any returned lot must be in the original auction holder with lot tag and seal intact. Large, miscellaneous or “bulk” group lots cannot be returned for any reason.
3. Successful bidders are required to pay the full invoice amount before lots are delivered. Terms of this sale are strictly cash or cash equivalent. ****Please note, should payment be made via check in any form the auctioneer reserves the right not to deliver lots until after all funds have cleared. Payment should be made in US Dollars by check, bank check or wire transfer. Anyone paying by credit card via Paypal in any form will be subject to a 20% buyer’s premium and possible administrative or handling fees.
4. A 20% buyer’s premium is in effect with payment forms in cash equivalents receiving a 2% discount to a net 18% when bidding via Icollector.com. Unpaid accounts will be subject to a 5% monthly interest charge and will be sold to the under bidder. The difference in price along with interest charges will be billed to the non-paying bidder and turned over to a collections agent after 30 days. Late paying bidders will no longer be able to bid or receive catalogs. Other auction houses will be informed of late paying practices..
5. Terms of this sale are strictly cash and must be paid immediately in US Funds. Payment should be made immediately upon receipt of invoice. Payments from overseas accounts must be made by wire transfer or via an acting agent in the USA, all wire fees to be bourne by the bidder. Shipping and insurance is at the bidder’s expense and no parcels will be shipped without full insurance and customs declaration documents.
6. Postage, insurance and handling fees are added to all shipments. There will be a minimum charge of $5 per parcel. All lots mailed outside the USA are charged an additional 1% processing fee. Overseas bidders must supply fully detailed shipping instructions and full customs declaration as well as agreement to all terms of sale within.
7. Sales tax will be collected on non-coin lots in the amount of 6% for delivery to Michigan addresses unless a valid MI resale number is provided.
8. Title to all lots remains with the auction house until payment in full is received. The auction house reserves the right to accept or reject any or all bids at its discretion. Generally bids below 60% of the estimate range will not be accepted. Placing a bid in this sale either in person, by agent, by mail, email, phone, fax or internet you are making a legal contract in Michigan by the auction house entering your bid and recording it. Any disputes arising from this contract will be governed by Michigan law. In the event of non-payment the auction house may elect to proceed judicially, in which case the bidder consents to jurisdiction and venue in the courts of Ingham County, MI. If an account is referred to an attorney for collection, the buyer agrees to hold the auction house harmless and to indemnify it for all costs of collection including actual, reasonable attorney fees and interest on the entire amount until paid.
