<p>ACTION NOTICE
<p>On request of the owners of the assets to be auctioned, the Action House & Gallery FORUM 9/11 s.r.o., Na Pøíkopì 9/11, 110 00 Praha 1, ID-No.: 26426951, holds an auction on December 7th, 2002, 2 p.m. at the Hotel Jalta. This voluntary public sale is held in accordance with the stipulations set forth in law no. 26/2000 Coll., on public auctions, abiding by law no. 121/2000 Coll., Copyright Act, law no. 26/1987 Coll., National Memorials Act, and law no. 71/1994 Coll, On the export and sale of assets of cultural value.
The objects listed in this catalogue will be exhibited on the premises of the Forum 9/11 gallery, from Thursday, Nov. 28th, 2002, till Friday, Dec. 6th 2002, from 10 a.m. to 6 p.m. and Saturday, Dec. 7th, 2002, from 10 a.m. to 1 p. m.
The auctioned objects are specified and described in the catalogue of sale, inclusive of the lowest bid (starting price) and the estimated price (as assessed by a professional appraiser); the auction catalogue is an appendix and indelible part of this auction notice. The auction’s course is subject to the Rules of Proceedings for Public Sales that are displayed on the premises of the auctioneer’s hall.
<p>1. Auctioneer
Upon the demand of the auction broker or one of his proxies, the participants are obliged to prove their identity with an official ID card or passport or, as the case may be, present their power of attorney to act on behalf of the bidder; they are also obliged to have themselves enlisted in the list of auction participants and to submit a declaration of honour according to which they are not ineligible for public sales. If the bidder is a legal person, then their proxy has to prove his authorization to act on their behalf by ways of an excerpt from the Commercial Register dating back not more than 6 months, and by a valid ID card. During the auction, the participants make their bids in person, using exclusively their bidding number plate that is available for a refundable deposit of CZK 500,-.
<p>2. Enrollment of bidders
For bidders, it is possible to enroll either before the auction, on the exhibition premises of FORUM 9/11, or on the day of the auction itself, an hour before the auction begins and exclusively at the venue of the public sale.
<p>3. Written bids
A participant may also make his bid without being present at the auction, based upon a power of attorney with date, address and phone contact that authorizes the auction broker to represent him at the auction. This power of attorney must contain the catalogue number, the detailed description of the object and the maximum purchase limit that the proxy may bid. In the event of equal limits, the limit that has been submitted earlier has priority. In the event of the price achieved during bids being equal to the limit, the adjudication goes to the bidder who is present at the auction hall. The auction office maintains confidentiality about the limits; it may condition the acceptance of powers of attorney with the payment of a deposit.
<p>4. Bidding via phone
Subject to an agreement with the auction office, the participant may bid via phone. The respective power of attorney must contain the same data as stated above for written offers, except for the purchase limit.
Upon the respective agreement with the auction office, all written offers and all motions for bidding via phone must be registered in person, one day prior to the commencement of the auction at the very latest.
<p>5. The course of auction
The auctioned goods are put up in the order listed in the catalogue, subject to organizational changes by the auction broker.
After the respective object is put up, the participants may make their bids by raising their number plate. The auction continues as long as bids are made. The auction broker may deny a bid without giving reasons. If, despite two calls by the auction broker, no further bid is made, then the auction broker announces the last bid again and, after a third call, knocks down for the benefit of the participant with the highest bid.
The participant is bound by his bid. The bidding price may not be curtailed afterwards.
The adjudication goes to the participant whose bid was knocked down. Any disputes in this regard are settled exclusively by virtue of the auction office’s decision.
If even upon repeated call, no one makes the lowest bid, then the object is deemed unfit for auction.
<p>6. The increments
The Auctioneer states the increments as follows

The Auctioneer reserves the right to decide the order and amount of the increments.
<p>7. The buyer `s premium (provision)
The Auctioneer will charge a provision of 15 per cent of the hammer price plus V.A.T. on the provision on behalf of the purchaser.
<p>8. Terms of Payment
The bidder is obliged to pay the price achieved in the public sale during or after the auction, however, 10 calendary days after the day of auction at the very latest.

- by credit card (VISA, MASTER, DC)
If the price is not paid by the bidder within the stated term, the auctioneer will nullify the adjudication without delay (i.e., without any additional respite), whereby the object becomes unfit for auction.
<p>9. Passage of ownership and takeover of auctioned goods
If the bidder makes payment of the price within the stated term, the ownership passes onto him as of the moment of adjudication.
The objects will be handed out to the bidder upon payment of the auction price in full, based upon a payment certificate, either on the day of auction, on site (until 6 p.m.), or on the premises of the Forum 9/11 auction hall during standard office hours, i.e. Mon – Fri., 12 p.m. to 6 p.m.
If the payment is made non-cash, then the bidder acquires ownership and is being handed over the object only after a certificate proving the transfer of money to the auctioneer’s account.
<p>10. Final Provisions
The objects are sold in the condition as of the moment of adjudication. Upon granting the adjudication, the auction hall’s liability expires. The items are described in the catalogue in all conscience; they are put up irrespective of defects or of faulty description. The catalogue’s pictures serve for identification only. Any damage that, with regard to the exhibit’s age, equals standard wear and tear, is not mentioned in the catalogue. All data concerning authorship, attributed qualities, authenticity, origin, date, age, provenance, condition, starting price and possibly estimated price express merely the auction hall’s opinion. The participant is to acquaint himself with the condition of the auctioned object prior to the auction; it is an exclusive matter of his consideration whether the object matches the description. Any reclamation is hereby excluded.
Items marked with an asterix (*) may be purchased by citizens of the Czech Republic only, who will be obliged to prove their identity with an official ID card or passport by the payment. Export of property with cultural value is liable to a special regulation according Law No. 71/1994 Col., concerning the selling and exporting objects of cultural value. Export of these objects from the Czech Republic can be carried out only by proving by certificate that they have not been declared cultural heritage or national cultural heritage, that they are not part of a set declared cultural heritage of national cultural heritage and that they are not liable to the regulation according to Law No. 20/1987 Co. in force regarding state heritage care.
The participants subject themselves to the Rules of Proceedings for Public Sale which are drawn up in compliance with Czech law and the respective legal stipulations in their current wording. All transactions that are governed by, or origin from, these Rules of Proceedings, as well as all related matters, are governed by Czech law.
