TERMS AND CONDITIONS:
1) A buyer' premium of 20% is added to the price knocked down by the Auctioneer. California sales tax of 8.5% is applied to all purchases- for purchases where delivery is taken in California- unless a valid resale number is on file. Resale numbers from any state are acceptable, but a California resale certificate must be completed. This is required by the State of California. A completed resale certificate AND a photocopy of the original resale license must accompany payment for any payments not including California sales tax. Payment should be made to,

2) Payment terms are bank wire transfer or cash. WE DO NOT ACCEPT CREDIT CARDS or PAYPAL. In all cases payment must be made in full one week after the sale. Invoices not paid by that date will be treated as "Non-Paying Bidders" and reported to Ebay.
3) Shipping is the responsibility of the buyer. Buyer agrees to hold auctioneer harmless for any and all damages. Prices quoted are for packing and shipping within the continental United States by a carrier of the auctioneer's choice and does not include insurance. We will advise you of insurance charges after the sale Items are shipped in the order payment is received and cleared. Buyer may use any third party packing and shipping service to deliver any purchases provided purchases are paid for within five days and picked up within TWO weeks. We will not be held responsible for accidents or other damage for property left in our possession more than 14 days after auction. 4) The Auctioneer is acting as agent only and is not responsible for acts of its principals. If any dispute arises, the Auctioneer's word is final.
5) Where the Consignor is indebted to or has a monetary guarantee from Slawinski Auction Company, and in certain other instances, Auctioneer may have
an interest in the offered lots and the proceeds there from other than its commissions, and may bid therefore to protect its own interests. Auctioneer reserves the right to withdraw any lots from the sale or cancel a sale at the Auctioneer's discretion. The Auctioneer reserves the right to reject any bid or eject any person from the premises.
6. Though all description and commentary are believed to be correct, neither Auctioneer or Consignor makes any warranties or representations
of any kind with respect to merchandise with the exception of the catalog description which shall be honored with respect to age and origin and only to the extent that any such errors in the catalog description materially affect the value of such item. Condition reports are made to the best of our ability, but are not guaranteed. Buyer shall not rely on the Auctioneer, employees, or advertisements in any part, and must rely only on the catalog description and his own inspection and opinions of all items. No employee is authorized to make any warranties, expressed or implied, on behalf of Slawinski Auction Company. All inquiries should be made by the Friday prior to sale by 3pm. Condition reports are to the best of our knowledge and all framed artwork is not inspected out of the frame unless stated.
We can not refund shipping or insurance costs. Claims must be made against the final catalog as revised by any addendum or auctioneer announcements. Claims may not be made against advertisements, website descriptions, or the preliminary catalog offered on our website. Items described as "possibly", "probably" or "attributed to" are not guaranteed, but represent our best opinion. When the term "bearing" preceeds the description of a mark or signature it is in our opinion NOT the work of that artist or maker. No guarantees are made as to condition. ALL MECHANICAL ITEMS- SUCH AS CLOCKS AND MUSIC BOXES ARE SOLD AS-IS. We can not be held responsible for these items not being in working condition after leaving our building.
7. Due to the fact this is a live auction with bidders in the gallery, on the phone, absentee(in the gallery) and on the internet you may place a bid absentee on Ebay and still not prevail when the selling price is the same or, in some cases, lower than that bid. The reason for this is that the auctioneer takes bids from where he/she sees them first. A person relays internet bids to the auctioneer and sometimes the auctioneer will see one of the other bids (gallery, phone or gallery absentee) first. If the Ebay record of an auction shows the Ebay bidder at the top of the bids, but has a floor bidder at the same price THE FLOOR BIDDER BOUGHT IT. This occurs at every live auction where internet bids are handled- usually several times every auction. The fact that Ebay says the earlier bid takes precedence is only true for bids placed on Ebay. The auctioneer in a live auction DOES NOT KNOW YOUR TOP BID and, in fact, doesn't know whether your bid is absentee or in real time. IF YOU EMAIL ABOUT THIS ISSUE YOU WILL BE DIRECTED TO THIS PARAGRAPH. We will not return calls on this issue. If you need further explanation call Icollector. Also some bids may be delayed due to data transmission (and human transmission) so that the auctioneer never recognizes a bid from the internet. Occasionally the auctioneer may eliminate or reject an eBay Live bid because it was neccessary to reopen a lot after the close of the eBay live bidding (usually because we missed an audience bid). The auctioneer is the final determination on who is the winning bidder- NOT THE INTERNET CLERK or EBAY RECORD OF BIDS.
