<p>1.) Good faith - We have attempted to make every effort to catalog and
describe all items correctly. If you need additional information please
contact us. Each item is guaranteed to be as described in this catalog -
no further. Condition is arbitrary and cannot be guaranteed. If you have a
question on condition or need more information, please call.
<p>2.) Terms - All items are to be paid for in American Funds the day of
the auction. Buyer must establish an account prior to the auction to pay
by check. Letter of Credit or Guarantee Card may be requested. Credit
cards are accepted with a 3% charge to cover Auditorium phone charges.
<p>2a.) Absentee bidders: Directly after the auction a bill will be
sent to you for your purchases. This bill will be due upon receipt.
<p>3.) Reserves - This is basically an unreserved auction. For the few
items that might have a reserve it will be conservative. Reserves in most
cases will not exceed 75% of the low estimate.
<p>4.) Withdrawal - We reserve the right to withdraw any property from the
sale at any time and shall have no liability whatsoever for such withdrawal.
<p>5.) Title - A title passes to the buyer at the fall of the auctioneers
hammer or the announcement of sold. The buyer then resumes the
responsibility of removal of any items purchased.
<p>6.) Responsibility - If you are acting as an agent for a buyer or
bidding for someone else, please be advised you are responsible for the
payment of that item regardless of your arrangement with the other person.
<p>7.) Nominal bids - Small opening bids or very nominal advanced may be
rejected by the auctioneer.
<p>8.) Protested bids - In a case of a disputed bid the auctioneer is the
sole arbitrator as to whom the successful bidder is; and may off the item
for bidding again.
<p>9.) Taxes - Any state or local taxes must be paid by the buyer unless
the buyer has proof of exemption. Taxes are charged on total of hammer
price plus buyers premium. (Wyoming sales tax is 4% at the time of this
printing)
<p>10.) Firearms - Any firearm will be sold according to all state and
federal laws.
<p>11.) Estimates - We publish estimated prices as a convenience only.
These are based on approximate sold prices of past sales and are only
educated guesses on our part.
<p>12.) Shipping - We will have a shipping company on the premises for your
convenience. Mail and phone bidders may use this service or make other
arrangements. The auction will, as a service to Purchasers, arrange to have
the property packed, insured, and shipped, all charges collect, at the
request, expense and entire risk of the Purchaser. Any claims will be
between carrier and owner (purchaser).
<p>13.) Fax bidding - Mail bid forms may be faxed and used for bid
execution with an established account. Fax bids will only be excepted
until the start of the preview. (8:00 A.M. June 24th)
<p>14.) Phone bidding - We will make arrangements with you in advance to
call you collect just prior to the lot being sold. If you would like to
bid by telephone please advise us as far in advance of the auction date as
possible. We take no responsibility for problems with phone service.
<p>15.) A 15% buyers premium will be charged on all items sold.
<p>16.) These conditions of sale and any other applicable conditions, as
well as the Purchaser's and auction's rights and obligations herein shall
be governed by, construed and enforced in accordance with the laws of the
State in which the auction is held. If these conditions are not complied
with by Purchaser, the auction may, in addition to other remedies available
by law, including without limitation, the right to hold the Purchase liable
for the total purchase price stated on the signed Confirmation for Purchase
Slip, wither (a) cancel the sale and retain as liquidated damages any and
all payments made by the Purchaser of (b) resell the property privately or
at public auction on three days notice to the Purchaser for payment of any
deficiency in the purchase price and all costs including handling charges,
warehousing, the expense of both sales, the commissions, reasonable
attorney's fees, any and all other charges due and incidental damages.
<p>17.) If we are prevented by fire, theft or any other reason whatsoever
from delivering any property to the purchaser, our liability shall be
limited to the sum actually paid therefore by the purchaser.
<p>18.) By registering for this auction, you are agreeing to these
conditions.
