PLEASE READ CAREFULLY – THE FOLLOWING CREATES A CONTRACT – ALL SALES FINAL
PAYMENT: All items are being sold for cash. All purchases must be paid with cash, certified funds or approved check. Approved checks are issued by: customers having established credit with Auction Firm, or with an irrevocable letter of credit addressed to The Michael Angelo Auction Company.
1.SETTLEMENT: All invoices must be paid in full before leaving the premises within 30 minutes of the auctions conclusion. Any Purchaser not complying will be subject to a 25% surcharge upon settlement.
2.TITLE: When the article is announced SOLD by the auctioneer it immediately becomes the Buyer’s responsibility. Title to the item transfers to the Buyer at that time. The Seller(s), however maintain a first security interested in all items until payment is received, including the collection of all funds. The Auction Firm and its personal assume no responsibility for any missing items and ARE NOT acting as the Buyers security agent.
3.INSPECTION: All goods have been available for inspection and are being sold on an AS-IS basis with all inherent faults, if any exist. Items are being sold without guarantees’, expressed or implied, as to the correctness of description, genuineness, authenticity, condition of fitness of purpose.
4.REMOVAL: The Buyer is responsible for removal of all items purchased; this responsibility cannot be passes by the subsequent resale of the item(s). Any items not being removed will be considered abandoned and will be removed at the Buyer’s expense, including rental of dumping containers. The Buyer agrees to the Risk Clause as it appears on this registration form.
5.DISPITES: In the event of a tie bid or a dispute bid, the Auctioneer in his sole discretion may determine the successful bidder, or he may resale the item(s) in dispute. Should a dispute arise after the auction, the Auction Firm’s Sales records will be deemed final. In no instance will a dispute be recognized once the item(s) had (have) left the premises.
6.REGISTERATION and BIDDING: Registration is required to participate in auction. Only registered bidders will be able to be declared successful. If the high bidder is found not to have a valid bidding number, the items(s) will be immediately marked to the last bidder at their prevailing bid amount.
7.GROUPING: The Auction Firm acknowledged that they are the agent of the seller, and reserve the right to group and divide any or all lots for the benefit of its clients.
8.SALES TAX: State sales tax will be charged when applicable as determined by the Auction Firm. Purchasers shall not be subject to sales tax when they furnish acceptable proof of exemption and sign ALL REQUIRES FORMS.
9.BUYERS PREMIUM: A 15% percent Buyer Premium will be added to all high bids to determine the invoice amount.
10.POOLING: Pooling or bid rigging is a fraud and a federal offence. The Auctioneer reserves the right to bid on behalf of the Seller(s) if he detects or suspects this fraud by two or more bidders.
11.AUCTION DAY ANNOUNCEMENTS: Any announcements made by the Auctioneer on the day of the auction take precedence over any printed materials or pervious assertions.
12.ADMITTANCE: The Auction Firm reserved the right to refuse admittance to anyone for cause, or to cause have them removed from the auction arena anyone who interferes with the auction activities.
13.LEGAL REMEDY: By bidding, you acknowledge complete acceptance of these terms & conditions, thus creating a contract. Failure to comply after the purchase may result in any legal recourse available. The undersigned & the Auction Firm agree that in the event of a dispute, they will be settle said dispute by binding arbitration in Hamilton County Ohio. By purchasing, you agree to hold harmless the Seller(s) and /or Auction Firm for the cost of all litigation including but not limited to: reasonable attorney fees, court cost, collection fees & all other associated cost.
14.You have read and agree with the Auctioneer Terms and Conditions above and the ICollector Terms of Use Agreement.All items are considered with reserve with Auctioneer,Associate or Authorized person(s)on behalf of Seller(s) permitted on bid on their behalf. All items maybe sold single auction site or dual to attain the highest dollar amount per item for Seller.
