<p>1. PAYMENT: All purchased must be paid with Cash, Visa, MasterCard, Discover or Check (with photo ID and SS #). There will be a $40. 00 fee for all returned checks.
<p>2. SETTLEMENT: All invoices must be paid in full before leaving the premises and within 30 minutes of the auction conclusion. Any Purchaser not complying will be subject to a 25% surcharge upon settlement.
<p>3. TITLE: When the article is announced SOLD by the Auctioneer, it immediately becomes the Buyer’s responsibility. Title to the item transfers to the buyer at that time. The Seller(s) however, maintain a first security interest in all items until payment is received, including the collection of all funds. The Auction firm and its personnel assume no responsibility for any missing items and are not acting as the Buyer’s security agent.
<p>4. INSPECTION: All goods have been available for inspection and are being sold on an As-is, Where-is basis with all inherent faults, if any exist. Items are being sold without guarantees, expressed or implied, as to the correctness of description, genuineness, authenticity, condition or fitness of purpose.

The Buyer is responsible for removal of all items purchased. This responsibility cannot be passed by the subsequent resale of the item(s). Any item not removed will be considered abandoned and will be removed at the Buyer’s expense, including rental of dumping containers, rental of material handling equipment, and all associated labor costs.
<p>6. EXTENSIONS: On a case-by-case basis and the Seller’s discretion, the Seller(s) may grant a removal extension with a nonrefundable extension fee on a per day basis. Payment of this extension fee must be made on a day-by-day basis, preceding the day of extension.
<p>7. DISPUTES: In the event of a tie bid or a disputed bid, the Auctioneer at his sole discretion may determine the successful bidder, or he may resell the item(s) in dispute. Should a dispute arise after the auction, Auction firm’s sales records and tape recording(s) will be deemed final. In no instance will a dispute be recognized once the item(s) has left the premises.
<p>8. REGISTRATION and BIDDING: Registration is required to participate in the auction. Only registered bidders will be able to be declared successful. If the high bidder is determined not to have a valid number, the items(s) will be immediately marked to the back bidder at their last prevailing bid price. Bidding increases will be in increments as the Auctioneer, in his sole discretion directs. The Auctioneer can reject any other increments.
9. GROUPING: The Auctioneer acknowledges that he is working for the Seller(s) and reserves the right to group or divide any and all lots for the benefit of his client.

<p>13. AUCTION DAY ANNOUNCEMENTS: Announcements made by the Auctioneer on the day of the auction take precedence over all previous oral assertions and printed materials.
<p>14. ADMITTANCE: Seller(s) and/or Auction Firm reserve the right to refuse admittance to any once for cause, or remove anyone from the auction arena for interference with the auction activities.
<p>15. LEGAL REMEDY: By your bidding you acknowledge complete acceptance of these terms and conditions creating a contract. Failure to comply after purchase may result in any legal recourses available.
