You must provide your real name, telephone number, e-mail address, mailing address, and other information as requested. You will need to select a user name and a password. You are entirely responsible for maintaining the confidentiality of your user name and password. Furthermore, you are entirely responsible for any and all activity which occurs under your user name and password. You agree to immediately tell us of any unauthorized use of your ID or any other breach of security known to you. We may terminate the subscription of anyone due to the misuse, improper use or unauthorized use of their user name, password or this site. We will not be responsible and you will hold harmless AMOUR D'ART for any actual, special, consequential or incidental losses or damages arising from the misuse, improper use or unauthorized use of your username, password or this site.
We recommend the following guidelines for creating a password. DO NOT make your password the same as your username. The password should not be a word that appears in the dictionary. Strong passwords should contain at least eight characters and should contain a mixture of upper- and lowercase letters, digits, and special characters.
ART - OIL PAINTINGS, LITHOGRAPHS, SERIGRAPHS & OTHER TYPES OF ART
are guaranteed as to artist, signature and medium. Exact measurements, condition and value are not guaranteed unless specifically stated as Guaranteed in the description in the catalog and/or website. The condition of frames and matting are not guaranteed and are not cause for voiding a sale. Certificates of authenticity are provided for informational purposes only and are not a guarantee of grade or value. Any dispute concerning the certificate of authenticity is between the issuer and the buyer. Any question as to authenticity must be resolved within 5 days of receipt of artwork and is the sole responsibility of the buyer.
BIDDER'S PREMIUM
A bidder's premium OF 12.5% (twelve and one percent) applicable for all auctions. Look at the site fees for premium. The premium is a separate charge from the item purchased.
THIS IS A LEGAL CONTRACT. Your bid or offer to buy is your agreement. You acknowledge and agree that a bid or request to buy a product is a legal and binding offer to buy the product.
We may alter our site at any time, add or remove features, auctions, events or services without liability to users. Such changes shall be at our sole discretion. Changes may be made without prior notice and will be effective immediately. It is the responsibility of the bidder to review all terms and conditions before bidding. By bidding on an item, you agree to accept all terms and conditions of the event.
SHIPPING
Most items will be shipped using UPS Ground with delivery confirmation within seven days. Insurance is mandatory for items that are sold for $50 or more. Insurance charges are included in the shipping charge you see posted in the auction. AMOUR d’ART will not be responsible for uninsured items. Most item descriptions will clearly indicate the shipping and handling charge. This charge is to ship within the Continental US. Additional charges will apply to international shipments and also Alaska, Hawaii and Puerto Rico. Any customs charges, taxes or duties are the responsibility of the bidder. We can only ship to an address that is verified through the Address Verification System of the credit card that was used to pay for the item. We ship all items to the address that was used when you registered. We do not ship to a P.O. Box.
Please allow 3-5 business, day after the auction has closed, for shipping.
To ensure your item is delivered to you and is not lost, we always ship with delivery confirmation. Delivery confirmation also allows you to track the status of your package.
Insurance is mandatory
RIGHTS TO SUSPEND OR TERMINATE
You agree that this web-site, in its own discretion, may terminate any auction or use of the service immediately and without notice if (a) we believe that you are not abiding by the general rules of this web-site (b) you have repeatedly broken a certain term (c) we believe you to be a non-paying bidder.
YOUR CONDUCT
You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the buying of items does not violate any applicable laws or regulations.
This site and its services are to be used only for lawful purposes in a lawful manner. Users agree to maintain compliance with all applicable laws, statues, and regulations regarding the use of the website, including in regard to bidding and purchasing products. You may not register under a false name or use an invalid or unauthorized credit card. You may not make bids under a false name or impersonate any participant. You may not bid on products with the intent of not paying for said products. Such fraudulent conduct is a violation of Federal and State laws.
RETURNS
Regardless of the above-mentioned terms, all sales are final and auction items are non-returnable after 5 days of receipt. Returns are only accepted with prior written or email approval of AMOUR d’ART. Shipping fees are non-refundable, and there will be a 15% restocking fee. Late payments negate any return privilege. Unauthorized returns will be at the sole risk and loss of the sender.
