<p>The property Iisted in this cataIogue will be offered for sale or soId by the G. Ray Hawkins Gallery Inc. (the gallery) and any consignor of such property for whom the gallery acts as agents upon the following terms and conditions as amended by posted notice or oral announcement during the sale.
<p>1. All bids are to be per lot as numbered in this catalogue.
<p>2. As used herein the term “final bid” means the price at which a lot is knocked down to the buyer, and the term “purchase price” means the aggregate of (a) the final bid (b) a premium of fifteen percent (15%) of the final bid payable by the purchaser and (c) any California State and local sales tax or compensating use tax of another state due thereon. Unless exemption from such taxes is established to the satisfaction of the gallery, the purchaser shall be required to pay the tax to the gallery and seek a refund from the state of California. As part of its renumeration, the gallery has been authorized by the consignor to retain the 15% premium referred to above out of the purchase price due the consignor.
<p>3.All property is sold “AS IS” and neither the gallery nor the consignor makes any expressed or implied warranties or representations as to the correctness of description, condition, size, importance, merchantability, rarity, provenance, genuiness, attribution, or period of the property. No statement made in the catalogue, or by any employee of the gallery, prior to, during or after the sale, or in the bill of sale or invoice or else where whether written or oraI shaII be deemed to be such a warranty or representation. Nor shall the consignor or gallery be held responsible for any such statement. Condition statements in the catalogue are frequently misinterpreted and therefore are rarely included in the descriptions. PROSPECTIVE BIDDERS ARE URGED TO PERSONALLY INSPECT THE PROPERTY BEFORE THE SALE TO DETERMINE TO THEIR SATISFACTION THE DESCRIPTION, SIZE, CONDITION AND WHETHER OR NOT IT HAS BEEN REPAIRED OR RESTORED. Prospective bidders who are unable to preview the material are urged to call the gallery.
<p>4. Not withstanding the above conditions, if within 21 days of the sale of any lot, the purchaser gives written notice that the property is a forgery and if within 14 days after such notice the purchaser returns the lot to the gallery in the same condition as when sold and establishes to the satisfaction of the gallery that the lot is indeed a forgery, then the sale shall be rescinded and the original purchase price refunded. The consignor agrees to be bound by the gallery’s judgement concerning rescission. This guarantee applies only to the identity of the author, creator, period, or as the case may be, as set forth as a heading in bold type caps and may proceed one lot or a series of lots. Rescission is the sole remedy in the event this paragraph is invoked and neither the seller nor the gallery shall be liable for any incidental or consequential damages arising from the sale of any property.
<p>5. The gallery reserves the right to withdraw any property before actual sale.
<p>6. Each lot marked with a • next to the lot number is offered subject to a reserve which is the confidential minimum price below which that lot will not be sold. In general, reserves will be somewhat below the low estimate printed in the catalogue. However, reserves will never exceed the high estimate. The gallery may implement the reserve by bidding through its agents or representatives on behalf of the consignor. In certain instances the consignor may pay us less than our standard commission rate when a lot is “bought in” to protect its reserve. Where the consignor is indebted to or has a monetary guarantee from the gallery, and in certain other instances where the gallery may have full or partial interest in the offered lot, the gallery is acting as principal rather than agent, and the proceeds therefrom other than our commissions. Reserve prices and estimates of such property will be treated the same as consigned property and bidding by the gallery or its representative to protect said reserves will be done in the same manner as for the consigned property.
<p>7. The gallery reserves the right to reject any bid. The highest bidder recognized by the auctioneer shall be the purchaser. In the event of any dispute between bidders or in the event of a doubt on the part of the gallery as to the validity of any bid, the auctioneer will have final and sole discretion either to determine the successful bidder or to re-offer and re-sell the property in dispute. If any dispute arises after the sale, the gallery’s records shall be conclusive.
<p>8. As a convenience to the clients who cannot attend the auction, they may submit bids by telephone, in writing, or in person prior to the sale. Telephone bidding during the sale itself must be pre-arranged. “Buy bids” will not be accepted. All bids must state the highest bid price the bidder is willing to pay exclusive of the 15% premium which will be added to the bid price. Should identical bids be submitted, the earliest received shall take precedence. All order bids will be executed in competition with other order bids, telephone bids, reserves and bids received from the audience. The gallery offers this service without charge as a convenience only and will not be held responsible for error or failure to execute bids. Successful bidder shall be notified by invoice detailing purchases and requesting payment and clearance of property. Unsuccessful bids are not acknowledged.
<p>9. On the fall of the auctioneer’s hammer, title to the offered lot shall pass to the highest bidder acknowledged by the auctioneer in accordance with all of the conditions set forth herein and thereupon (a) assumes full risk and responsibiIity therefore (b) may be required to sign a confirmation of purchase thereof and (c) will pay the full purchase price or such part as the gallery may require. All purchases must be paid for in full and be removed from the gallery not later than 3 (three) business days after the sale at the sole risk and expense of the purchaser. The purchaser of any lots which remain at the gallery after three such business days will incur a charge for storage and handling of $1.00 per calendar day for each lot. If the foregoing conditions, or any other applicable conditions herein, are not complied with, in addition to other remedies available including, but without limitation, the right to hold the purchaser liable for the total purchase price. The gallery, at its option, may either (a) cancel the sale, retaining as liquidation damages all payments made by the purchaser or (b) resell the property on 3 days notice either privateIy or at pubIic auction without reserve .In either case the purchaser shall be liable for any deficiency plus all costs and expenses for both sales including our regular commission rates and all other charges due hereunder and incidental damages.
<p>10. A premium of 18% of the bid price will be added thereto and is payable as part of the purchase price.
<p>11. All purchases must be paid for the day of the auction. Payment is to be made by (a) cash (b) cashier’s check (c) personal check with approved references. PROSPECTIVE PURCHASERS UNKNOWN TO US ARE ADVISED TO MAKE ARRANGEMENTS BEFORE THE SALE FOR PAYMENT AND SUPPLYING OF REFERENCES. UNLESS SUCH ARRANGEMENTS ARE MADE, PAYMENT WILL BE ACCEPTED ONLY IN CASH FOR IMMEDIATE DELIVERY. CHECKS MUST BE CLEARED BEFORE DELIVERY.
<p>12. If the gallery is prevented by fire, theft or any other reason whatsoever from delivering any property to the purchaser, the sole liability of the gallery and the consignor shall be the sum actually paid by the purchaser. Packing and handling of purchased lost by us is for the convenience of, and at the entire risk of, the purchaser. The gallery is not responsible for the acts or omissions of carriers or packers of purchased lots.
<p>13. Neither the gallery nor consignor makes representation that the buyer of any property listed in this cataIogue or offered for sale in any way whatsoever will acquire reproduction rights thereto.

<p>NAME OF ARTIST
<p>Each lot is guaranteed to be the work of the artist or author whose name
appears in bold caps as a heading and may proceed a single lot or a series
of lots. Terms of guarantee apply only to authorship.
<p>TITLES
<p>Known or generally accepted titles have been used whenever possible;
otherwise, descriptive titles have been used.
<p>PRINTS
<p>Unless stated, all prints are vintage prints. That is, they are accepted as
having been made by the artist or under his or her care and specifications
at the approximate time that the negative was made. Specific printing dates are
rarely known. Where a print is not considered "vintage", the description
will state "printed later." The date immediately following the title is the date
of the negative. In the case of non-vintage prints, when the printing date is
known or can be approximated a second date will be shown.
<p>MEASUREMENTS
<p>Measurements are given in inches and refer to the image size. Height
precedes width.
