(1807 - 1870) Confederate General and commander of the Army of Northern Virginia, arguably the most brilliant commander of field armies in American history. Very fine A.D.S. ""R. E. Lee"" 1p. legal folio, Lexington, Nov. 18, 1865, in which Lee swears that he had personally prohibited any looting or trespass by soldiers under his command! Lee's document is contained within a deposition taken at his home in Lexington, in response to a court order in the case of William Meracle, plaintiff, vs. Mary Staub, Jacob Chapman and Charles Roush, defendants of Berkeley Co., West Virginia. Following his being sworn, Lee chose to write his testimony himself, in full: ""that Genl orders were issued to the troops, prohibiting all trespass upon, & seizure of private property, & ordering that offenders should be promptly arrested & punished. These orders were communicated to the several Commanders, & to the Genl. Staff Officers of the Army, who were required to see to their execution"". Accompanied by the original partly-printed document ordering a West Virginia commissioner in Virginia to obtain the statement of ""Robert E. Lee, late General of the Confederate Armyàan important witnessà"". We believe that the lawsuit came about as a result of alleged damage to property caused by Southern soldiers and/or agents, and here plaintiff Meracle seeks redress as Berkeley County experienced severe destruction during the war. In June 1861, Stonewall Jackson destroyed the railroad cars at the Martinsburg B&O Railroad complex, commandeered the engines, and had the roundhouse and machine shops completely stripped. The first major conflict in the area occurred on July 2, 1861, when Union general Robert Patterson crossed the Potomac River at Williamsport and defeated Johnston and Jackson. Additionally, at war's end Lee's detractors sought his arrest and trial for ""depredations"" committed by his armies, and for his own ""traitorous"" conduct. Very good condition.
