1. All Internet bidders must be registered with eBay and must supply Churchill Crocker Auctions with their name, address, phone number, and a valid credit card. We reserve the right to refuse bids from bidders with negative feedback or poor credit/payment histories. Bidders on eBay Live Auctions (both real time and absentee) must be registered and pre-approved by the close of the last business day before the start of the auction.

2. Churchill Crocker Auctions will make every effort to bid on behalf of eBay Live Auction bidders in a timely manner; however, we are not liable for transmission delays due to variations in connection speed, disruptions in Internet service, or service outages by our ISP or the bidder’s ISP.

3. There may be minimums and opening bids placed on some items. The highest bidder when the auctioneer’s hammer falls shall be the buyer, and any dispute shall be settled at the Auctioneer’s absolute discretion. An audio recording is made of each auction to verify auction results, if necessary.

4. The Auctioneer has the right at his absolute discretion to refuse any bid, to begin the bidding and to advance the bidding as he may decide. The Auctioneer will make every effort to adhere to the opening bids and bidding increments set forth in our online catalog; however, he may at his sole discretion alter either at any time during the auction.

5. We reserve the right to withdraw any property at any time for any reason before the actual sale thereof. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalog.

6. Lots will be available for preview before the auction at our Auction Site and in our online catalog. All prospective bidders should inspect the property they wish to purchase prior to bidding. If a bidder is unable to view an item in person, he or she is responsible for obtaining a condition report and/or additional photographs prior to bidding to determine an article’s condition, size, and degree of restoration. All bids are considered to be proof that the bidder has inspected the item(s) or chosen to bid without inspection of the item(s).

All property is sold “AS IS,” “WHERE IS,” and “WITH ALL FAULTS,” and neither Churchill Crocker Auctions nor the consignor makes any guarantees, warrantees, or representations, expressed or implied, with respect to the property or the correctness of the catalog or other description of the authenticity of authorship, physical condition, size, quality, rarity, importance, provenance, or historical relevance of the property. No statement anywhere, whether oral or written, shall be deemed such a guarantee, warranty or representation. All information in the catalog is believed to be true and correct. 8. ALL SALES ARE FINAL and are considered to be legally binding contracts. The winning bidder is legally obligated to pay the purchase price and all other applicable fees and taxes within 5 business days after the auction. Title to property shall not pass to the buyer until the purchase price has been paid in full, but purchased property shall be at the buyer’s risk in all respects from the fall of the hammer.

9. Payment can be made by money order, wire transfer, personal checks (approved by Churchill Crocker Auctions), VISA, or Master Card. Invoices not paid within 5 business days after the auction will be automatically charged to the buyer’s credit card on file. Personal checks may be accepted as payment at the sole discretion of Churchill Crocker Auctions, in which case the auctioneer reserves the right to hold the property until a buyer’s check clears. There will be a $25.00 handling fee charged each time a check is returned from the bank for any reason.

10. California Sales Tax will be charged on 1) The Hammer Price of the property, and 2) the Buyer’s Premium (unless the buyer provides auctioneer with a valid Resale Certificate at the time of registration) for any items sold at our Auction Site or online for shipment to a California address.
<Br>
11. Merchandise to be picked up or shipped by the buyer must be removed from our premises at the buyer’s expense by the Wednesday following the sale. After 7 days, any merchandise remaining at our Auction Site will incur a $5 per day per lot storage fee. Merchandise which is paid for but not picked up or shipped by the buyer within 14 days after the auction will be considered forfeited. Such merchandise will be resold and the buyer shall be liable for any deficiency plus all costs and expenses of both sales, our commission and buyer’s premiums at our regular rate, and all other charges due hereunder.

12. If we are unable to deliver goods sold because of loss due to fire, theft, or any other reason, our liability shall be limited to the sum actually paid by the purchaser.

13. SHIPPING. Churchill Crocker Auctions does not pack or ship.
