John Adams autograph letter signed with exceptional content expressing strong opinions about the United States, its leaders, military strength and foreign powers during the War of 1812. Letter is also accompanied by the original envelope with Adams' free franked signature. Written on 5 December 1812 from Quincy to his son-in-law William Stephen Smith, who at the time was running for Congress, Adams expresses his deep concern for America's future in the letter, which reads in full: ''Dear Sir / I received yesterday your favour of the 16th of last month. It is of no other use to ruminate upon the faults, Errors, and blunders of Congress and Washington in the revolutionary War, or upon those of Congress and Jefferson or Congress and Madison during the last twelve years; than to derive wisdom from their costly experience, and rectify our counsels and correct the conduct of our arms for the future. There are some truths in which every American Citizen ought, by this time, to agree: one of which is, that We ought from hence forward forever, at all hazards, and at any expence, to erect and maintain an irresistable Superiority of Naval Power upon all the Lakes and Water Communications, Unless both Nations will Stipulate, that neither Shall have a Single Cannon afloat upon any of them. Another is that we ought to direct our most Strenuous Efforts, and to apply our most ample resources to the Establishment and Maintenance of a Naval Power Sufficient to protect our Commerce, our Atlantic Frontier and the Missisippi River. The Frankness & promptitude of Military Gentlemen ought always to be the result of previous and cool deliberation and a perfect knowledge of the Subject. Hull and Burgoine & the Prince of Brunswick were prompt and frank to their disgrace and ruin. They would all Say, they meant to Speak daggers but use none. The Address of the Delegates at Hartford to the Counties of Madison and Herkimer, is prettily written, with a lively, nimble pen; but is it not too fluent upon the Occasion? Has it touched the nerve of Sensibility in the Nation, or in the Counties? Does it express the general Sense of the People? I should have advised the suppression of a few party reproaches, that I think are not well founded. The Allusion to Baltimore and King might have been Spared. However I presume they know best. if you are elected, you will find yourself in a new Scene of Life, where all your Patience, Prudence, Caution and Self Government will be indispensable. You will not Seldom have to pitty the Vanity and forgive the rudeness of gentlemen who will be loquacious, though vastly your inferiours in Age Rank and Services. I hope Dearborne Smyth and Harrrison will not go the way of Hull, and Van Ransaleer: but my Palsied Nerves quake for fear. Whether Madison or Clinton be Elected, he will deserve to be pittied; and ought to be supported with all the Energy and Unanimity possible: though there is reason to fear, that in the present discordant State of Society, Such felicity is not Attainable. A Peace with England, founded in Submission to disgraceful terms, by a Surrender of any Rights by the Law of Nations would not only be offensive, but really injurious to France and involve Us at once in a War with that Power; and however lightly, One Party may think of Such a War, and however ardently they may desire it, they would find it not easy to get rid of it. We could not annoy France who could hurt Us considerably, and We could hope to obtain no Satisfaction from either Power for the unnumbered Ships and Cargoes they have pyrated from Us. The Party aims at an Alliance with England and if they obtain it: farewell to Peace. A perpetual War with France and all her Allies must follow. While the divisions in our Nation and the Convulsions in Europe render the times difficult and perplexed, there never was more Occasion for Dr Moody's doctrine, which was solemnly enjoyned upon me when I was going to Congress in 1774. 'In times of difficulty and danger, when Men know not what to do; they ought to be very carefull that they do not do, they know not what'. I can do nothing but pray, and that I do most devoutly from my heart for the Blessing of Heaven upon the Counsels and Arms of our Country, and upon you and yours, whether you are to be publickly one of our Counsellors and defenders or not. My Love to Abigail, Caroline and all; especially to All worthy Justus, with whom I was a little miffed, when he wisely refused to be one of my Captains; but applaud him and thank him for it now. There is, they say, an intrepidity of Face and a magick in the Eye of some Serpents, which fascinates Birds, Squirrels & ratts into Jaws open to devour them. This Faculty, Quality, or Power, in Men, overcomes Women, Children and Men too of the highest Station very often. It is called an imposing countenance. You and I have seen it and its mysterious Effects in several of our great acquaintance, whome I will not name at present. I have seen it in one Instance where you hint that you have seen it. If you ever saw, Silas Deane you must have seen it in great perfection.'' Letter spans three pages on one card-style sheet measuring 14.75'' x 9'', double-framed so that the entire letter can be read. The fourth page contains the address panel, with Adam's free franked signature, ''J. Adams'', addressed to Smith in Hamilton, New York. Entire framed presentation measures 46'' x 25'' and weighs 18 lbs., 9 oz. Some separation along folds, though archivally reinforced, and bit of paper loss from wax seal, though not affecting content. Toning is minimal and letter is highly legible. Overall very good plus condition.

AUCTION REGISTRATION

BIDDING
This is an internet, mail, fax and phone auction. The final day of bidding for all lots is Thursday, July 27th, 2017. In order to be eligible to bid on a lot during the Extended Bidding Period that begins at 5:00PM PST on July 27th, (the final day), you must have placed a bid on that lot before 5:00PM PST on Thursday, July 27th. If only one bid at or above the Minimum Bid has been made on a lot when the Initial Bidding Period ends, that bidder will be declared the winner of the lot at the end of the auction. For any lot that has two or more bidders, bidding will remain open until 30 minutes pass without a bid being placed on that INDIVIDUAL LOT. Lots will end at different times depending upon bid activity.
BID NOTIFICATIONS VIA EMAIL
Upon placing a successful bid making you the high bidder, you will receive an email notification confirming that you are current high bidder on that lot. If and when you are outbid on that lot, you will receive a new email notifying you that you have been outbid. In the event that you place a bid but are immediately outbid by another bidder's Maximum Bid, you will be notified instantly on the computer screen that you have been outbid and will not receive an email notification.
MINIMUM BIDS, BIDDING INCREMENTS AND MAXIMUM BIDS
Each lot in the auction has a Minimum Bid (designated in the printed catalogue and online as "MB"). When bidding, you will be able to view the current high bid for each lot. When you want to bid, you will click through to the individual lot page. There you will be able to view a pull-down menu of incremental bid amounts. You will have the option of selecting the next incremental bid (the lowest amount that the pull-down menu displays) or any bid higher than the next incremental bid (a Maximum Bid). If you select a Maximum Bid, the auction program will bid incrementally on your behalf one bid at a time up to but not exceeding your "maximum" bid amount with the intention of winning the item at the lowest possible price. Bid increments are set at 10% increases. In the event that two or more bidders place the same Maximum Bid, then the earliest received bid will be recognized as the successful high bid.

We ship via FedEx & USPS upon clearance of payment. Shipping includes expedited air shipping and insurance with signature confirmation. You will be notified of all shipping charges upon confirmation of your winning bid.
PAYMENT
There is a buyer’s premium payable on top of the hammer price. This amount will be added to the winning bid. Payment methods accepted include personal and cashier’s checks, and wire transfers. We do not accept credit cards. All payment must be made in U.S. dollars. CA sales tax of 9.25% is charged as applicable. Full payment is due within 14 days of the ending auction date unless an exception is made in writing. Late payments have a 1.0% fee per month added to them.

CONDITIONS OF SALE FOR AUCTION
The following constitutes the entire terms and conditions on which property listed in the catalogue shall be offered for sale or sold by Nate D. Sanders, Inc. and any consignor of such property for whom we act as agent.
1. Bid Price. As used herein the term "bid price" means the price at which a lot is knocked down to the purchaser and the term "purchase price" means the aggregate of (a) the bid price, (b) a buyer's premium payable by the purchaser of twenty-five percent (25%) on the first $200,000, plus twenty percent (20%) of any amount between $200,000 and $2,000,000, plus twelve percent (12%) of any amount over $2,000,000 per lot of the bid price and (c) any applicable sales tax.
2. Purchases. This is an online, mail, phone, email and fax bid auction. As of closing time printed below, the highest bidder shall be deemed to have purchased the offered lot in accordance with all of the conditions set forth herein and thereupon (a) assumes full risk and responsibility therefore (b) if requested will sign a confirmation of purchase, and (c) will pay the purchase price in full or such part as we may require for all lots purchased. No lot may be transferred. All property shall be shipped at the purchaser’s expense. Each sale made pursuant to these Conditions of Sale will be deemed to constitute a grant of a security interest by the purchaser to us in, and we may retain as collateral security for the purchaser’s obligations to us, any of the purchaser’s property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the purchaser. Whenever the purchaser pays only a part of the total purchase price for one or more lots purchased, we may apply such payments, in our sole discretion, to the lots we choose. Payment will not be deemed made in full until we have collected all amounts due in cash or good funds represented by cleared checks, cashier checks or bank wires. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the consignor by law, including but without limitations, the right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by purchaser or (b) resell the property, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our commission at our standard rates, all other charges due hereunder, attorney’s fees and incidental damages.
3. Sold As-Is. All autograph signatures, letters, documents and signed photos are sold "as is". All statements contained in the auction or in any bill of sale, invoice or elsewhere as to period, culture, source, origin, measurements, quality, rarity, provenance, importance, exhibition and literature of historical relevance or physical condition are qualified statements of opinion and not representations or warranties. The Purchaser hereby accepts the benefit of the consignor’s warranty of title and other representations and warranties made by the consignor for the purchaser’s benefit. The Purchaser expressly acknowledges and agrees that in no event shall we be liable for any damage including, without limitation, any compensatory, incidental or consequential damages. In the event the item auctioned is an intangible item including but not limited to dinner with a celebrity, etc., Purchaser acknowledges that they may have to submit to security requirements and screening procedures that such person should employ. Purchaser bears the risk of not meeting security requirements and screening procedures.
4. Right to Withdrawal Property. We reserve the right to withdraw any property at any time before the actual sale. We reserve the right to reject a bid from any bidder. The highest bidder acknowledged by us shall be the purchaser. In the event of any dispute between bidders, or in the event we doubt the validity of any bid, we shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article. If any dispute arises after the sale, our sales records shall be conclusive in all respects. If we are prevented by fire, theft or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid therefore by the purchaser and shall in no event include any incidental or consequential damages.
5. Subject to Reserve. If a lot is offered subject to a reserve (the confidential minimum price below which the lot will not be sold), we may implement such reserve by bidding on behalf of the consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. NDS may own some or many of the lots in this sale.
6. Descriptions and Defects. We have tried to accurately describe every item in this auction. Condition description ranges are: poor, fair, good, very good and fine, poor being the lowest level and fine being the best condition. Substantial defects are noted, minor defects may not be mentioned. If any substantial defect not described in the auction is discovered by the purchaser, the lot must be returned within two days. This is not an approval sale. Any return for any reason other than authenticity issues will not be accepted.
7. Payments. All items are to be paid for by (a) cash, (b) bank wire, (c) cashier check or (d) personal check made to "Nate D. Sanders, Inc." All sales are final. No bid can be withdrawn at any time. All payment must be in U.S. dollars. Full payment is due within 14 days of the ending auction date unless an exception is made in writing. Late payments have a 1.0% fee per month added to them.
8. Choice of Law and Arbitration. These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by California law. By bidding at an auction, whether by web, fax, mail, telephone or other means, the buyer or bidder agrees to be bound by these Conditions of Sale. Any dispute, controversy or claim arising out of or relating to the Agreement or the breach, termination or validity thereof, brought by or against NDS (but not including claims brought against the consignor by the purchaser of lots consigned hereunder) shall be resolved by Arbitration in Los Angeles, California under the AAA consumer rules of Arbitration. The Arbitrator shall be empowered to order specific performance and to award consequential damages and pre-award interest, but shall not be empowered to award punitive damages. The arbitration shall be governed by the U.S. Arbitration Act, 9 U.S.C. 1-16, and judgment upon the award rendered by the Arbitrator may be entered by any court having jurisdiction thereof. Each party shall bear its own attorney’s fees and expenses in connection with such proceedings and shall bear one-half of the Arbitrator’s fees and expenses.
9. Successors and Assignees. These Conditions of Sale shall bind the successor and assignees of all bidders and purchasers and inure to the benefit of our successors and assignees. No waiver, amendment or modification of the terms hereof shall bind us unless specifically stated in a writing signed by us. If any part of these Conditions of Sale is for any reason invalid or unenforceable, the rest shall remain valid and enforceable.
10. Advanced Bids. We accept bids in advance of sale by web, telephone, email, fax or mail. "Buy" bids will not be accepted; all bids must state the highest bid price the bidder is willing to pay. As noted above, a premium payable by the purchaser will be added to the bid price. In the event identical bids are submitted, the earliest will take precedence. We assume no responsibility for failure to execute these bids for any reason whatsoever.
11. Estimated Prices. As a convenience to our clients, we furnish pre-sale estimates for all lots included in the auction. These are intended as an approximate guide to our opinion of current market value, and should not be interpreted as a price. The final bid price may well be less than or more than any estimate printed.
12. Intellectual Property. Unless otherwise indicated, the purchase of any lot does not give the buyer any copyright ownership.
13. Shipment. Shipment is via Fedex or the USPS unless otherwise instructed. Shipping charges are added to all invoices. Items are shipped after receipt of payment.
14. Entire Agreement and Severability. These Conditions constitute the entire agreement between the parties together with any exhibits, schedules and addenda incorporated by reference herein. They may not be amended, modified or superseded except in a signed writing executed by all parties. These terms and conditions shall be binding and enforceable on the signatory parties and all heirs, successors, assigns, beneficiaries, executors, and principals (where executed by an agent on behalf of said principal). If any of these terms and conditions are for any reason deemed invalid or enforceable, the remaining portions shall remain fully enforceable without regard to the invalid or unenforceable provisions.
