<b>316. JOHN MARSHALL</b> (1755 - 1835)<b> </b>Supreme Court Chief Justice and the principal founder of the American system of constitutional law, including the doctrine of judicial review. Fine content A.Ms.S. "<i>J. Marshall</i>" 2pp., small 4to., [n.p., n.d.], offering a legal opinion of an estate case beginning with the significant facts of the case, in which a W. Edwards, deceased, leaves money to his children by his second wife, Lucy Pemberton. Marshall writes in part: "<i>...I am further informed that the money mentioned in the will was paid to Lucy Pemberton them Lucy Edwards as the Guardian of her infant children...</i>". In light of the father's death, the children of Edwards's first marriage apparently demanded a portion of the estate. Marshall notes: "<i>...I consider the question concerning the validity of the payment as being too doubtful for the ex[eutor] to hazard the distribution of the residuary estate on the opinion of any lawyer...I am therefore decidedly of opinion that this is a case which ought to be laid before the chancellor by a friendly suit brot [sic] by the children of the second marriage against the ex[ecutor] & the children of the first. The same suit may procure a sale of the land without additional expense".</i> Small losses from chipping along right margin, not affecting text, light dampstaining, otherwise very good condition.<b> $2,500-3,500</b>
