Final responsibility for evaluation of the authenticity and condition of the objects remains with the buyer, unless faulty information is a result of gross negligence on behalf of Anders Antik. Anders Antik reserves the right to change the catalogue descriptions in writing or orally in connection with the auction. Buyers may view their purchases, identifying themselves by a code obtained from Customer Service. Droit de suite Pursuant to the Swedish Copyright Act a droit de suite (artistic royalty) of 5% (exclusive VAT) of the hammer price will be payable by the byer for works of art by artists during their lifetime and another 70 years thereafter. Works of art selling for less than SEK 1.845 are excluded. Items for which droit de suite is to be paid are listed on a notice in the auction room and on a separate list attached in the catalogue. Liability for defects All objects are sold as they are. Prospective buyers should themselves make sure of the quality and condition of the objects before the auction. Anders Antik does accept any liability for natural wear and tear, minor damages and defects etc. Clocks, clockwork and instruments etc are sold as objects of art with no guarantee for their technical function. Complaints regarding defects for which Anders Antik may be responsible must be made as soon as possible and no later than 30 days after the auction. If complaints regarding defects for which Anders Antik may be responsible are not dealt with by Anders Antik within 30 days, the buyer has the right to cancel the purchase and, having returned the object, receive the amount paid. The buyer is not entitled to any further compensation. Anders Antik thus disclaims any responsibility for other damages and costs that may have fallen upon the buyer in connection with the purchase. Disputes Disputes concerning these terms shall be settled in accordance with Swedish law at a court in Sweden. Bidding General The highest bidder is the buyer at the hammer price. Any person bidding on behalf of another party is liable for completion of the sale. In the event of equal bids or disputes that may arise during the bidding, the auctioneer alone will decide which bid confers the right of purchase. The auctioneer is entitled to disregard bids from any unreliable bidder and to determine whether bidding shall be resumed because of doubt concerning the last bid. The auctioneer is also entitled to decide the minimum increment of the bids. At the request of Anders Antik bidders shall be able to document their ability to pay and to provide proof of their identity at any time. By person Bidding should be made in a clear voice or by unambiguous sign, preferably by using a numbered paddle, which may be obtained from Customer Service before the auction. By telephone or via Internet Telephone bidding and bidding over Internet is possible within conditions made out by Anders Antik. Anders Antik is not to be held responsible for any mistakes or errors that may occur using these services. By commission Written bids for a specified object are accepted up to 1 hour before the auction starts. The same time limit applies for changes or withdrawals of a submitted bid. When bidding commissions are submitted, acceptable references and proper identification of the buyer may be requested unless he already has a reference number with us. Bidding assignments are free of charge. Anders Antik treats bidding assignments confidentially and bids as favourably as possible on behalf of the buyer. However, Anders Antik is not liable for any loss that the client may be caused if Anders Antik fails to carry out the bidding assignment. It is furthermore up to the customer to find out whether his bid has resulted in a purchase. Payment Purchase price The purchase price shall be the hammer price plus a buyer’s premium of 24 % including Swedish VAT. Foreign buyers wanting to avoid payment of VAT should contact Customer Service before the auction to obtain relevant information.
