Here, the wealthy uncle, Gustavus Pfeiffer, of Hemingway's second wife Pauline, is recognized as donor of the trust and Hemingway is appointed trustee. Dated 4 January 1936, document reads: “Dear Ernest, Pursuant to the right reserved to me under the terms of Paragraph IV of the Trust Agreement, made the 17th day of November, 1936, of which you are the Trustee, to deliver additional securities to become part of the Trust Estate thereunder, I, as Donor, am delivering herewith to you, as Trustee, Certificate #B-361, for forty (40) shares of William R. Warner & Company, Inc., Second Preferred Stock, having a par value of $100 per share…” Hemingway “acknowledges receipt of and accepts the above addition to the Trust Estate and agrees to administer the same according to the terms of the said Deed of Trust, dated November 17, 1936.” The Trust Estate was to be used for the education, maintenance and support of Hemingway’s eldest son until he turned 21, then paying him the net income from the trust until he was 30 when the principal of the Trust Estate would be transferred to him.
