Buyer’s Terms & Conditions:
Buyers must except the following Terms & Conditions to participate in Bitterroot Frames Inc auction. Please note that when you enter into a bid, you enter into a binding contract to purchase your item per the terms listed. Please do not bid if you don't intend to follow through on your purchase. The auctioneer reserves the right to accept or reject your bid at the close of the auction, even if you're not the high bidder. You will receive a confirmation email within 24 hours of auction close if your bid has been accepted. There is a $100 fee on any item that you bid on, win and fail to pay for. If you dispute the charge to your credit card which you have agreed to, there will be an additional $100 charge to pay for our time and costs in collecting the disputed charge.
1. Bitterroot Frames, Inc reserves the right to withdraw Property at any time before or at the sale and shall have no liability for such withdrawal.
2. All Property will be sold “AS IS”.
3. At the end of the auction, the Purchaser shall pay the hammer price and a buyer’s premium . In addition, Purchaser will be responsible for the price of packaging, insurance and shipping of the purchased artwork. Payment Due: Buyer shall communicate with Seller within three (3) days of the completion of the auction. Complete payment is due upon receipt of notification of a successful bid and shall be received by the Seller no later than 10 days following the auction. Title shall pass to the Buyer once payment in full has been made. All shipping charges will be borne by the Buyer.
4. Terms for all purchases will be credit card (VISA/MasterCard/American Express) with settlement and payment due in full the day of the sale unless otherwise arranged. All monies shall be made payable to Bitterroot Frames Inc.
5. Some items of Property may be offered subject to a “reserve” or confidential minimum price below which the item will not be sold. In such instances, Bitterroot Frames Inc may implement the reserve by bidding through the Auctioneer on behalf of the Consignor. In no event shall the reserve exceed the low estimate in the catalogue.
6. Neither Bitterroot Frames Inc, nor Auctioneer, nor Consignor make any representations whatsoever that the Purchaser of a work of art will acquire any reproduction rights thereto.
7. Biding on any item indicates your acceptance of these terms and all other terms announced at the time of sale whether bidding in person, by phone, by Internet, by absentee bid, or through a representative.
8. In most instances, sculpture measurements do include the base. In measurements for two-dimensional art, height precedes width, original paintings include frames and Limited Edition Giclee prints does not include frame.
9. Online Bidding: By registering to bid through Bitterroot Frames Auctions you agree to accept our policies of bid history disclosure, including the policy that live online bidder’s increments are not reported when bidding against an absentee bid until the absentee bid is surpassed. Please register to bid well in advance of the start time. Bitterroot Frames Inc will not be held responsible for errors or failure to execute bid(s).
10. Winning Bid: The highest bidder shall be the buyer and if any dispute arises between two or more bidders, the auction coordinator shall decide the buyer.
