1. All descriptions are subject to errors and omissions, and should only be used as a guide. Questions concerning individual lots should be directed to the Auctioneer by e-mail or by phone. Except as set out herein, there shall be no warranty or guarantees expressed or implied, statutory or otherwise of any nature. No sale shall be invalidated by any reason or defect or inaccuracy of description in the inventory or otherwise, and no liability shall be borne by Auctioneers by virtue of any such fault or error. All sales are final.
<p>2. Internet live auctions and all absentee bidding will be subject to a 10% buyer’s premium.
<p>3. On-line bidding during the live auction is a fast process, and therefore no confirmation is given. Bids will be taken immediately and are irrevocable.
<p>4. The highest bidder shall be the purchaser upon the completion of bid verification. Bid verification will commence upon the conclusion of a live auctioned and may last 48 hours. All winning bidders shall be notified by e-mail within the 48 hour bid verification period.
<p>5. No bidder shall retract their bid. In the event of a dispute between two or more bidders, the Auctioneer, at his sole discretion may put the lot up for resale to the highest bidder.
<p>6. A bidder is deemed to have accepted an item As Is when making a bid.
<p>7. The Auctioneer reserves the right to withdraw any lot at any time prior to the time of sale of such lot.
<p>8. The Auctioneer reserves the right not to accept any bid which is only a partial advance over the preceding bid.
<p>9. The Auctioneer may break down or consolidate any lot or lots at his sole discretion.
<p>10. Mark Mattox Real Estate Broker and Auctioneer, Inc. assumes no responsibility for any liability once a bid is accepted.
<p>11. Attendance at the Auction preview, or removal by bidders and guests is done at their sole risk. Mark Mattox Real Estate Broker and Auctioneer, Inc. assumes no risk or liability, statutory, common law or otherwise whatsoever for the safety of those attending at the Auction premises.

<p>14. The purchaser is not entitled to possession until all items have been paid in full. In the event that the purchase prices are not paid within the prescribed time, the Auctioneer shall have the right to re-sell such items in whatever manner he sees fit without notice to the purchaser. Any shortfall from the sale plus commission and expenses thereof shall be paid by the purchaser.
<p>15. All costs and responsibility of removal and delivery shall be borne by the purchaser/bidder within the time prescribed by the Auctioneer. The purchaser/bidder hereby indemnifies the Auctioneer against any and all damages arising from the removal of any lot.
<p>16. Any lot not removed within the prescribed time shall be subject to storage, moving, disposal and service charges at the sole risk and expense of the purchaser. All such lots shall be deemed as abandoned and shall be subject to resale for the recovery of such charges.
<p>17. If for any reason, Mark Mattox Real Estate Broker and Auctioneer, Inc. is unable to deliver any or all of an awarded lot, the sole liability of Mark Mattox Real Estate Broker and Auctioneer, Inc. shall be the refund of any monies paid on the lot.
