The property will be offered by Top Gems unless the indicated otherwise. By participating in this auction, you acknowledge that you are bound by these terms and conditions including the following:
Payment Method
Payment must be received within 7 business days after the end of the Auction in U.S. dollars through Top Gems Account via PayPal. We only accept payment via PayPal.
All major credit cards and e-checks are accepted through PayPal. You are welcome to contact us if you have any difficulties with the check out process.
BUYERS PREMIUM
A 15% buyer’s premium will be added to all orders won in this auction event.
SALES TAX
Except not liable by law, the Buyer is required to pay California State Sales Tax of 7.75% (if located within California) and any compensating use tax of another state, and/or any federal luxury or other tax, on the total purchase price including the Buyer's premium (if any). Sales tax is only void if Buyer furnishes TOPGEMSJEWELRY a valid resale permit or if the merchandise is shipped out of the State of California.
Guarantee and Return Policy
If you are unsatisfied for any reason, you may return the item for a full refund within 5 days after receiving the item. Any jewelry that has been sized, set, unset or modified by the customers once they have received it is non returnable. All items must be returned in original condition. With our “Happy Money Back Guarantee”, please follow the return policy below.
You must obtain Return Material Authorization # by email prior returning an item. We do not charge the Restocking Fees. The merchandise must be returned in the original condition, properly packed and included the original jewelry box, jewelry tag, copy of the receipt and the gemological report. Failure to return any gem card will result in a $50 fee and $200 for silver mold.
Refund will be the winning bidding price less shipping and handling fee. Refund will be issued to your Paypal account within 10 business days after we receive the returned package.
Shipping and Handling
We do not ship to P.O. Boxes. The customers must provide us the physical address or business address. All of the merchandises are shipped with signature required. The shipping and the included insurance are based on the carrier’s standard rate. The delivery period will be within 10 days after completing the "check out" process and the payment is confirmed.
Top Gems is not responsible for loss or damage of property in transit. We are not responsible for the acts or omissions in our packing or shipping of purchased items or of other carriers or packers of purchased items, whether or not recommended by us. Any questions about shipping and handling costs are welcome to send to us via our contact email address before the auction ends.
Non-Paying Bidders
According to the agreement of the payment policy, if we do not receive the full payment within 7 business days, you will be in default and your right to the item(s) will be automatically fined. The notification of any delay of your payment is a must. Without any information of the delay, Top Gems will then file a Unpaid Item Dispute against you which can result in your account being suspended indefinitely.

“Negative Feedback” is highly discouraged. Please contact us first if you have any problem with our merchandise so that we can find a happy resolution for you. If the negative Feedback is issued, you will be filed in return in case that we are not agreed with you.
