Davis was sentenced to death for killing two sheepmen while working for the cattle ranchers Sparks and Harrell. He would be pardoned at the last minute when Nevada Governor John Sparks (yes, the same Sparks) appealed to the Governor of Idaho for a stay of execution. After he was released from jail, he found himself in Nevada and soon became associated with George Wingfield. When Wingfield wanted to break a miner's strike, Davis testified - untruthfully - against the union officials that broke the strike. He was also appointed by Wingfield as the sheriff of Goldfield to enforce the anti-union rules Wingfield had imposed! But he was a popular figure. Wherever he went, he drew a crowd.
