Union general (1825–1864) who fought as a division commander of General Sickles' 3rd Corps at Gettysburg, and took command of the corps after Sickles was seriously wounded. He also served with distinction with the Army of the Potomac in the 1864 Overland campaign; he was stricken with malaria and died on October 18, 1864. Civil War–dated ALS signed “D. B. Birney, Brig. General, Comd'g Div'n,” one page, 7.75 x 9.75, November 27, 1862. Letter to Governor E. D. Morgan of New York in the days preceding the Battle of Fredericksburg, regarding the resignation and reassignment of officers. In part: "No resignations of commissioned officers from this Division are accepted, unless, from physical disability, cowardice, or inefficiency, the public service should be rid of the person…May I ask your Excellency not to permit these officers to be re-commissioned, and returned to the service, groaning under imbecile and incompetent officers." In fine condition, with faint toning along folds.
