CDV by S. Bullock, Binghamton NY shows the bodies of two drowned men pulled from the Chenango River. They were presumed to have been accomplices in the robbery and murder of a store clerk named Merrick. Ruloff was found and convicted of the murder. This photograph was introduced at the trial as evidence used to identify them, the photographs having been shown to relatives. It was ruled that the photographs alone were not sufficient evidence for identification, but they could be used for corroboration in connection with other evidence. The judge's ruling said the photographs "were not artistic pictures, nor in all respects the most perfect likenesses that could be taken." This was a landmark decision regarding the use of photographs as evidence. Slightly light. Tack hole at top of the mount. Trivial slit at extreme left edge of print. [D2+]
