Clarence Darrow. Superlative A.L.S. on capita
Clarence Darrow. Superlative A.L.S. on capital punishment, of one of the most important legal minds of the twentieth century. On his personal letterhead, June 20, n.y. but backstamped 1928. To Mr. Allen, 1 closely-written page. "...I do not believe there is any biological argument for or against capital punishment. If I said this in my review, I was wrong. What I meant to say was that in my view Calvert's(?) book would have been stronger if it had been based on biology than it is now. The trouble with the book which I did not emphasize is that it is shot full with old religious conceptions about man & his rights. Still it is an exceedingly good book. The Nation of Man as derived from biology (not religion) should be the basis of any effort of anyone to judge him. In this sense since there is a biological aspect but no other. If man is only a mechanism responding to stimuli, then of course he is not the subject of moral judgements. I hardly think it needs an article on that, but if you have you might send this letter to Boulder [probably one Dr. Earp of that city mentioned earlier in this letter]. I wish I had more time to write for your publication but I don't although most of my time is wasted at that." Last three letters of "Darrow" slightly smudged, by his own hand, trivial toning at top portion, else fine. The word "Autographs" in black crayon on verso, perhaps of an old-time antique dealer who placed this item atop a pile of manuscripts in his shop! A superb letter of Darrow, who was involved in the Debs, coal miners, Leopold-Loeb, Scopes, and Scottsboro trials.
