<p>By bidding in this auction, Prospective bidders (whether present in person, or by agent, by written, telephone, FAX, email, or through a live internet connection) agree to be bound by the following, including TERMS AND CONDITIONS, CONDITION OF ITEMS, HOW DO I BID?, and AFTER THE SALE. These are the complete and only terms and conditions on which all property is offered for sale.
<p>TERMS AND CONDITIONS
<p>Registration. All bidders must register their name, permanent street address (no P.O. Boxes please), and phone number prior to the auction. Bidders unknown to us are required to register a valid Visa or Mastercard number, and may be required to arrange for a bank letter of credit.
<p>Terms of Sale. The highest bidder for each lot shall be the buyer, and if any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the disputed lot shall be put up again at the last undisputed bid and resold.
<p>Buyer’s Premium. Successful bidders shall pay the hammer price of each lot, plus a 15%, added on buyer’s premium.
<p>Payment. Internet bidders are required to pay for their purchases immediately upon receipt of an electronic, or paper invoice. Acceptable forms of payment include personal check, bank check, bank transfer, Visa or Mastercard or Paypal .
<p>IF COWAN’S HAS NOT RECEIVED PAYMENT FOR WINING BIDS 10 DAYS AFTER BIDDERS HAVE BEEN NOTIFIED OF THEIR PURCHASES, THE BIDDER AUTHORIZES COWAN’S TO CHARGE THEIR PURCHASES TO THE CREDIT CARD LEFT ON FILE DURING THE REGISTRATION PROCESS.
<p>CATALOG DESCRIPTIONS
<p>Condition of Items in the Sale. Cowan’s Historic Americana Auctions does not warrant the condition of any lot sold. ALL PROPERTY IS SOLD AS IS, and neither Cowan’s nor the consignor makes any warranties or representations of any kind or nature with respect to the property or it’s value, and in no event shall they be responsible for correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of it’s value. No statement (oral or written) in the catalog, at the auction, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility.
<p>While condition reports for most items can be found online at Cowan’s website www.historicamericana.com, prospective bidders are urged to contact Cowan’s directly for detailed information regarding any lot. THERE SHALL BE NO RETURNS FOR ANY REASON.
<p>Estimates. Pre-sale estimates of the expected hammer price of each lot are provided for the convenience of prospective bidders. In most cases, they do not represent reserves. Bidders are encouraged to bid what they feel an item is worth.
<p>Dimensions. Unless otherwise noted, all dimensions are given in inches.
<p>HOW DO I BID?
<p>Internet bidding through icollector and ebaylive auctions is offered as a service to our customers, and prospective bidders shall not hold the auctioneer or his staff responsible for any errors or failures in executing bids, nor shall they hold the auctioneer responsible for any failure due to the loss of the auction aplet supplied to Cowan’s by ebayliveauctions.
<p>Absentee Bidding. Absentee bids left through ebaylive auctions and icollector auctions are automatically bid electronically by the computers of ebay. These electronic bids often compete against absentee bids left directly with Cowan’s staff by prospective bidders who are not participating in the internet component of the auction, but have contacted Cowan’s directly and “left” a bid. These bids are executed competitively by a member of Cowan’s staff at the time of the live auction, and are often in direct competition with the internet bids. In the event that there is a tie absentee bid, the earliest recorded bid shall be the winner.

<p>AFTER THE AUCTION
<p>Absentee Billing: Cowan’s will invoice all successful bidders within 72 hours after the close of the auction. Successful bidders are expected to pay for their purchases immediately. IF PAYMENT IS NOT RECEIVED WITHIN 10 BUSINESS DAYS AFTER THE MAILING OF AN INVOICE, ABSENTEE BIDDERS AUTHORIZE COWAN’S TO CHARGE THEIR PURCHASES TO THEIR CREDIT CARD LEFT ON FILE WITH THEIR ABSENTEE BID.
<p>Shipping: Shipment generally occurs within one week after payment has been received. Payment with a money order or bank draft expedites this process. We prefer to ship via UPS or Federal Express, and unless absolutely necessary, will not ship to a P.O. Box. For this reason, please provide a street address for our shipper. It will expedite your receipt of your purchase.
<p>Shipping Charges. Successful bidders are required to pay for all shipping, insurance and handling charges. Your purchases are valuable, sometimes irreplaceable, and important. We cannot, and will not skimp on making certain they reach you safely. You should be aware that for larger/and/or valuable items, shipping charges can be substantial.
We will be happy to ship smaller items in a priority mail box. These packages work fine for small, flat , but we are reluctant, however to use them for larger dimensional items or for high value lots. In general, only lots valued under $500 will be shipped in this form of packaging. THERE WILL BE A MINIMUM CHARGE OF $10.00 SHIPPING FOR ANY LOT SHIPPED IN A PRIORITY MAIL BOX.
<p>If you have a FED EX or similar overnight delivery account, we’ll be happy to ship via these services. Simply supply us with your account number, and we’ll expedite your shipping. Because we will still incur handling and packaging expenses for this service, however, you will still be charged a handling and packaging fee.
