1. While the Auctioneers have endeavoured to catalogue and describe correctly each article to be sold, guarantee is not made either by the owners, or by the Auctioneers of the correctness of description, genuineness or authenticity of any lot, and no sale will be set aside on account of any incorrectness, error in cataloguing, or any imperfections not noted. Every lot is on public exhibition two days or more prior to its sale, after which it is sold “AS IS” and without recourse.
2. The highest bidder for any lot shall be the buyer, and if any dispute should arise between bidders the Auctioneer shall have the absolute discretion to settle such dispute or, at his opinion, to put any disputed lot up again for resale or to withdraw any such disputed lot from the sale. The Auctioneer’s decision shall be final.
3. Any bid which is not commensurate with the value of the article offered, or which is merely a nominal or fractional advance over the previous bid, may be rejected by the Auctioneer, at his discretion, if in his judgement such bid would likely affect the sale injuriously.
4. A deposit of 25%, or more, of the purchase is required on adjudication, and the NAMES and ADDRESSES of the purchasers shall be given immediately on the purchase of their first lot. If the foregoing or any applicable condition is not complied with, the Auctioneer may cancel or reoffer the item for sale at his convenience.
5. Within 24 hours of the sale (Sunday and Statutory Holidays excepted) lots shall be fully paid for and removed from the Auctioneer’s premises at the buyer’s sole risk and expense. Should any lot not be fully paid for and taken away within the said delay then the Auctioneers shall have the right either to store the lot at the expense and risk of the buyer or to resell such lot at public or private sale, any deficiency and incidental expenses to be borne by the buyer, the whole without prejudice to any other right or recourse of the Auctioneers or the Seller. In no case shall any lot be released to a buyer until payment of the balance of the purchase price and accrued expenses, if any. Any sum paid by the buyer on account of the purchase price shall guarantee to the extent thereof, but without limitation, any liability of a defaulting buyer to the Auctioneers or the Seller.
6. SPECIAL CONDITION FOR ART SESSIONS - Notwithstanding the terms and conditions of sale listed above, if within ninety days the purchaser can prove in writing and beyond any reasonable doubt that the descriptions AS OUTLINED IN THE GLOSSARY contained in the catalogue are in effect inaccurate and the lot proves not to be authentic, Les Encans Pinneys, Inc., as agents for the consignor, will rescind the sale and refund the monies for the said lot.
7. BUYER’S PREMIUM – All lots purchased at our auction are subject to a premium of fifteen percent (15%) payable by all buyers as part of the purchase price.
8. EXPORT PERMITS - Certain property sold at auction by us may be subject to the provisions of the cultural property export and import Act of 1977. In order to export these items, special permits must be obtained from the Department of Communications. There are no assurances that any such licence can be obtained. 9. GOODS AND SERVICES TAX - All lots are subject to the Federal Goods and Services Tax (GST) on the hammer price. The GST is also charged on the buyer's premium without exceptions. All goods purchased for export from Canada will have the GST refunded on proof of export.
10. QUEBEC SALES TAX - All lots are subject to the Quebec Sales Tax (QST), which is
calculated on the total purchase price, including the hammer price, Buyer’s Premium and GST. All goods purchased for export from Quebec will have the QST refunded on proof of export.
