The buyer and the seller agree that Weidel Auctions is acting strictly as the contracted agent between the buyer and seller. All goods are sold on an “As Is, Where Is” bases, and no warranty, implied or otherwise, exists in relation to any goods offered for sale unless
otherwise announced. Descriptions provided are a guide only and “Do not constitute a warranty or guarantee actual or implied.” All goods are available for inspection before the sale and each purchaser shall be held to have satisfied himself as to identity, authenticity and condition and shall not be permitted to make any objection after the sale on any ground whatsoever. ALL SALES ARE FINAL. All goods must be paid in full on sale day by cash, Debit, Visa, MasterCard or e-transfer before any goods are removed from the premises. Bank draft is accepted but will be held until bank approval – 4 to 7 days. Ownership to any goods remains with Weidel Auctions and “Do Not” transfer to the purchaser until any or all goods are paid in full by the purchaser. Once any items are purchased, they become the sole responsibility of the purchaser. Any goods not paid for or within 3 days of end of auction, will be resold at any subsequent sale and any deficiency and/or costs charged to the purchaser and any future bidding approval will be denied. Goods knocked down to a purchaser lie at his risk immediately. Any subsequent damage, including any caused by auction staff during loading assistance, is at buyer’s sole risk. WEIDEL AUCTIONS IS NOT LIABLE FOR INJURY WHILE PUBLIC IS ON THE AUCTION PREMISES. The Auctioneer reserves the right to refuse or revoke any registration and to accept or reject any bid for any reason. In all cases of dispute, the Auctioneers decision shall be final. The Auctioneer does not warrant any goods to be free and clear of encumbrances but only that the auction company has obtained a statutory declaration of liens and encumbrances from the consignors. The Auctioneer further warrants that he will pay sale proceeds, less commissions, towards any liens on goods declared by the consignors thereof to be subject to liens or encumbrances. GST and a 15% HANDLING FEE applies to all purchases and will be charged in addition to the actual closing hammer price of every item at the auction sale unless otherwise announced, plus GST. Credit card payments are subject to 3.25% handling fee. Please be conscious of the handling fee and factor it into your bidding.
