For lots 76-83, 101, 149, 214-218 only a small quantity/portion of the lot will be available for preview at the auction venue and pick up of these lots at the auction facility will not be available. Lots 151-159 will not be available for preview or pick up at the auction venue.
7% sales tax will be charged to buyers taking possession in Florida unless a resale tax number is provided. Items will be relocated to Texas where 8.25% sales tax rate will apply to buyers if taking possession there and do not provide a resale tax number.

Appraisals are conducted under a separate contract with the U.S. Marshals Service, which is completely separate from the auction contract. The Buyer specifically agrees and acknowledges that the use of the term “tested” as used to describe articles of jewelry means only that the Auctioneer believes that the article described has been tested as to the gold or silver and the Auctioneer makes no warranty that the gold or silver content is as described. Likewise, the description of a diamond or other gem or the description of a particular brand does not constitute any representation or warranty that the article is as described. It is the Buyers sole responsibility to determine the authenticity of any item purchased.
The Estimated Price Range listed in the catalog is listed as a convenience to buyers. These prices reflect estimates based upon historical sales of similar items.
The Auctioneer has the right to reject any and all bids on behalf of the Seller and to bid as agent for any Absentee Bidder. The Auctioneer is not responsible for the acts or representations of the Seller. Seller shall retain full security interest in all merchandise until full and complete payment is made to Seller or Gaston & Sheehan Auctioneers.
Security for purchases is the responsibility of the Buyer and begins immediately upon the sale of each lot. Removal is at the expense, liability and risk of the Buyer. Auctioneer shall not be responsible for goods not removed within the specified time periods. Auctioneer shall not be responsible for non-delivery or for any other matter or thing to any purchaser of any lot, in any event. The U.S. Marshals Service retains the right to reject any bids for any reason or to make counter offers or accept back up offers at their sole discretion.
All Bidders Must Read and Acknowledge the Prohibited Parties Statement & Buyer's Certification:
USMS Policy Directive 13.7, Persons Prohibited from Purchasing Forfeited Property stipulates that certain individuals are prohibited from purchasing forfeited property in the Department of Justice (DOJ) Asset Forfeiture Program, directly or indirectly (through another person or agent) and are therefore barred from placing bids to buy such property:
a) U.S. Department of Justice employees, including U.S. Marshals Service employees, except as further restricted below;
b) U.S. Marshals Service employees directly involved with the Asset Forfeiture Program, and their immediate family members;
c) Contractors, sub-contractors and the employees of contractors and sub-contractors of the Asset Forfeiture Division, U.S. Marshals Service, who provide contract/management services for personal and real properties and complex assets, including, but not limited to, any person who has received compensation, directly or indirectly, from the Government in connection with the custody, management, and care of the assets;
d) Defendants in a Criminal Case - Titles 18.U.S.C. Section 1963(f) and 21 U.S.C. Section 853(h) of the Comprehensive Crime Control Act of 1984 prohibits the United States Government from reverting to a defendant or any defendant's conviction on charges, or violations of 18 U.S.C. Section 1962 or 21 U.S.C. Section 841 et. seq;
e) As a matter of policy, the USMS extends the purchase restrictions of a criminal case to any person whose conduct gave rise to a civil forfeiture of the property or to anyone acting in concert with or on behalf of, such a person. This general prohibition may be lifted in civil forfeiture actions on a case by case basis due to extenuating circumstances, as determined by AFD and the relevant United States Attorney's Office (USAO), with concurrence of the Ethics Officer, Office of General Counsel (OGC);
f) Other Third Parties- other governmental and non-governmental employees who are, directly or indirectly, involved in the Asset forfeiture and DOJ Equitable Sharing Programs; and
g) Anyone acting in concert with or on behalf of any of the above persons.
In accordance with title 18 U.S.C. Section 1963(g) and 21 U.S.C. Section 853(h), you must certify that you are not acting and will not act in concert with the defendant(s) from whom the property was seized or to any person whose conduct gave rise to a civil forfeiture of the property or to anyone acting in concert with or on behalf of such a person. Understand that any falsification of the information provided in this statement is punishable under the provisions of title 18, U.S.C., section 1001, by a fine of not more than $10,000 or by imprisonment of not more than 5 years, or both. All sales are subject to confirmation by the US Marshals Service.

Registration will be Thursday, July 31st from 11:00 A.M. to 4:00 PM. and Friday, August 1st starting at 8:30 A.M. and continues throughout the auction. To register you will need a valid photo ID and a $500 cash deposit. Deposits for unsuccessful bidders will be returned in the same form when exiting.
Upon the conclusion of the auction or bidding; Buyers will be required to verify purchases, make final payment and/or discuss final payment arrangements and receive checkout instructions prior to exiting the auction facility.
ONLINE SIMULCAST BIDDING: To bid you can register at TxAuction.com and submit a $1,000 deposit no later than 5:00 P.M. CST, on Thursday, July 31st to Gaston & Sheehan Auctioneers, Inc. by any acceptable payments listed below. The pre-bidding feature will be available throughout the auction.
