Bidder
The auction house is entitled to identify bidders before collecting the auction number and entering the auction hall. Identification of a bidder is carried out on the basis of produced papers verifying his or hers identity, e. g. identification card or valid passport. Proclamation of possessor of auction number is drawn up after verification of his or hers identity. The proclamation binds the possessor of the auction number to take over and pay all objects that he or she bought at the auction in accordance with the auction rules.
Course of auction
Everyone who produces admission ticket in the form of catalogue is entitled to collect his or hers auction number. The auction number is bound by 500,- Sk deposit. The deposit is paid back when the auction number is given back, at latest two hours after the last piece came under the hammer. The deposit will be under no circumstances paid back after this time. Who is not possessing the auction number is not able to buy at auction, only in the case that he or she is an acquisitor buying in the representation of someone.
Bidding
The auction of things takes place if bidders make a higher bid (bidding). The bidder bids by holding his or hers auction number clearly up. If more people bid, the person in charge of the auction (auctioneer) counts rising bids.
The organiser reserves the right to estimate the amount of the closest higher bid in accordance with the character of the thing sold at auction (by the price of the subject sold at auction):
up to 10 000,- Sk - 1 000,- Sk
up to 50 000,- Sk - 2 000,- Sk
up to 100 000,- Sk - 3 000,- Sk
up to 500 000,- Sk - 5 000,- Sk
more than 500 000,- Sk - 25 000,- Sk
Buyer
If none bids after the second call, the auctioneer repeats the last bid (the price reached in last bidding - the auction price) and sells the thing to the bidder. The buyer is the person to whom the last bidding was sold.
The ownership and the right to hand over the object sold at auction come into being only after payment of the whole sum of the object. The whole sum of the object is total of the price of subject sold at auction and auction commission.
Auction under limit
The auction house reserves the right to reduce the price of the object offered at auction supplementary. However, realization of sale of an object for a price lower than its limit price mentioned in the auction catalogue is conditioned upon supplementary approval of its owner.
Way of payment
In the course of auction is the buyer present at the auction obliged to pay the auction price cash. After the last object comes under the hammer after the end of auction, the buyer present at the auction is obliged to pay the auction price if he did not agree with the auction house on credit.
The auction house can give the buyer a credit which is conditioned upon payment of 20% total price deposit. The auction house is entitled to withdraw from the contract if the buyer is more than 14 days behind with payment of the total sum of object (including the auction commission). In that case the 20% from total price forfeits to the auction house as an equivalent of costs for selling the object at auction and the missed profit.
Auction price
Reached auction price (the last bid) is the buying price. The auctioneer gives the buyer a receipt for the payment. When paying the buying price the auctioneer charges the buyer 10% (up to the price of 80 000,- Sk), or 5% (price higher than 80 000,- Sk) of the price as a special auction commission. When paying by credit card the auction commission is 4% higher.
Taking part at an auction on the basis of authorisation
Bidder can buy any object at the auction without being present at the auction if he fulfils the following conditions:
· gives a written authorisation with date, signature and address to an acquisitor entitling him to substitute him at the auction
· appoints objects which the acquisitor has to buy for him or her
· sets a limit up to which the acquisitor is allowed to bid for each of the objects
The authorisation for substitution at an auction can be concluded 24 hours before the auction at latest considering the fact that the presence at auction is conditioned upon paying the deposit. Deposit in the amount of 20% from the price has to paid by the bidder when signing the authorisation. If the buyer is more than 14 days behind with the payment of the total sum of the object 20% from total price forfeits to the auction house as an equivalent of costs for selling the object at auction and the missed profit.
Taking part at an auction on the basis of telephone connection
Bidder can take part at an auction by telephone connection to the auction hall on the basis of a written agreement with the auction house. The agreement signed by both sides includes basic personal facts about the bidder, the object offered at auction and bidder's telephone number. The agreement of phone auction can be concluded 24 hours at latest before the auction.
Taking part at the auction on the basis of telephone connection is conditioned upon paying deposit. The bidder has to pay a deposit of 20% of price of the object when signing the agreement of telephone connection to auction hall. If the buyer is more than 14 days behind with the payment of the total sum of the object, 20% from total price forfeits to the auction house as an equivalent of costs for selling the work of art at auction and the missed profit.
The auction house carries all costs of telephone connection of the bidder to the auction hall.
Final regulations
Things offered at auction are usually old. All things are sold at auction without regard of defects and faults or imperfect description. Pictures in the catalogue serve only the need to identify the object. Bidder should find out the state of the offered thing before the auction and consider if the object corresponds to the picture in catalogue. With the exception of commitments carried by the auctioneer under these conditions, carries no tradesman, nor Auction house, its employees or acquisitors any responsibility for imperfect description or truthfulness or authenticity of any object offered at auction and hereby give no guarantee for any object sold at auction to any buyer. Any spoken or unspoken or presumed guarantees are hereby out of the question.
If the buyer produces the Auction house with a written proclamation that the thing sold at auction is a fake or has defects in text or in illustration and gives his auction number and date of auction at latest 30 days after the auction and gives the object back in the same state as during the auction and it is later confirmed that the object is really defect or fake, the Auction house withdraws from the contract of and repays the whole sum paid for the object.
All facts and proclamations included in the auction catalogue concerning the authorship, given characteristics, origin, date, age, provenience, state, price presumed auction price express only the opinion of the Auction house. Auction house is entitled to consult with any experts or official places while creating its opinion and follow their expression. Any participating person has to follow his or hers own opinion in similar concerns and the Auction house, nor its employees or acquisitors cannot carry the responsibility for the truthfulness of such an opinion.
