Payment Details:
Payment must be made in full immediately after the auction. Methods of payment accepted are: Cash (in sterling), Bankers Draft (in sterling), Building Society Cheque (in sterling, cheques (in sterling) with valid card. Goods will be retained until cheques have cleared.
<p>Instructions. As Goldings are Auctioneers, all goods delivered to their premises will be deemed for sale by Auction unless otherwise stated in writing and will be sold at Goldings discretion subject to these Conditions of Entry. By delivering the goods to Goldings for inclusion in their auction sales each vendor acknowledges that he or she has accepted and agreed to be bound by all these conditions.
<p>Collections. Goldings do not themselves usually undertake the collection of goods but will, if requested in writing, instruct a contractor on the vendor ’s behalf in their capacity as agents. Goldings disclaim all responsibility for loss or damage to goods or for unauthorised removal of goods and for damage to premises caused by the contractor who should be insured for such risks. Unless instructions are received to the contrary the charge for these services will be normally deducted from the proceeds of sale.
<p>Loss or Damage. Goldings disclaim all responsibility for loss or damage to goods, or for unauthorised removal of goods unless caused by the direct negligence of their employees.
<p>Storage. This is free of charge pending sale. If an unsaleable reserved item is not collected upon request and in all other circumstances storage will be levied at £1 + VAT per item per day.
<p>Goldings reserve the right to store or to arrange for the storage of goods delivered to them for sale either on their own premises or elsewhere at their sole discretion. They exempt themselves from any liability for loss or damage to goods delivered to their Salerooms without sale instructions.
<p>Right to sell. If items are not removed within twenty-one days of a written request to do so Goldings reserve the right to sell those items under these Conditions of Entry to defray costs and storage charges. (See 4.)
<p><b>Insurance.</b>
(a) Unless otherwise instructed in writing all goods on Goldings premises and in their custody will be held insured against the risks of fire, theft following forcible entry and water damage (but not against accidental breakage or damage) for which Goldings will charge a premium of £1.50 per £100 (minimum 10p). The value of the goods so covered shall be the gross amount realised, or in the case of unsold lots the best bid, or in the case of goods withdrawn prior to a sale that which the specialised staff of Goldings shall in their absolute discretion estimate to be the auction value of such goods.
(b) Goldings shall not be responsible for damage to or the loss, theft or destruction of any goods not so insured upon the owner’s written instructions.
(c) Goldings shall not be responsible for accidental breakage, loss or damage howsoever caused unless directly caused by negligence of their employees.
(d) In respect of any articles delivered to Goldings if the vendor has in force a policy or policies of insurance in which is specifically mentioned as being insured, whether or not for any agreed sum or value, the vendor shall notify his insurers of and shall himself note Goldings interest as bailee in such policy or policies
<p><b>Reserves & Estimates</b>
(a) All goods are put up for sale WITHOUT RESERVE at the Auctioneer’s discretion unless written instructions as to reserves are received by Goldings at least 24 hours prior to the commencement of the sale. The minimum reserve acceptable is £10.
(b) In the event of any reserve price not being reached at auction Goldings are empowered to sell after the auction by private treaty, at not less than the reserve price, as long as the goods remain on Goldings premises. In the event of such a sale by private treaty the Conditions of Sale applicable to a buyer governing the auction will apply.
(c) If any item fails to reach the reserve and no private treaty sale is made, it will be re-entered until collected. Each re-entry will empower the Auctioneers to reduce the reserve by 30% each time.
(d) ESTIMATES are not RESERVES. They are given purely for encouragement of bidders. Unreserved items may sell at a fraction of an estimate if no reserve has been agreed.
<p>Ownership & Indemnity. The vendor declares that the goods entered are their unencumbered property and that they are free from any hire purchase or financial agreement. The Vendor shall duly indemnify Goldings against any claims in connection with any goods sold by Goldings on the Vendor’s behalf.
<p>Value Added Tax. A vendor who sends for sale by auction any chattel(s) which is an asset of business must disclose to Goldings whether or not he is a registered person for VAT purposes and, if so, his registered number. This information must be supplied to the Auctioneer on or prior to delivery of goods.
<p>Photography. The vendor gives Goldings full and absolute rights to photograph and illustrate any lot placed in its hands for sale and to use such photographs and illustrations as they see fit. For each catalogue photograph the charges will be for colour £50 + VAT or for monochrome £20 + VAT. Copyright of photographs is vested in Goldings or their assignees.
<p>Vendor Commission. The vendor will be charged commission at the rate of 15% of the first £100 of each lot and 12.5% thereafter + VAT (minimum £1 per
lot) of the selling price. The Auctioneers reserve the right to split or consolidate items entered for sale and will be lotted at their discretion. Once items are entered for sale a withdrawal fee of 5% of the auctioneer’s lower estimate will be payable before their release. All plus VAT.
<p>Unsaleable & Unsold Lots. If any item is rendered unsaleable by virtue of any legislation, or by failure to attract a bid at auction Goldings reserve the right to dispose of that item WITHOUT FURTHER REFERENCE TO THE VENDOR. Such disposal will be charged at up to £8 + VAT per item (i.e. 3 piece suite £24).
<p>Electrical Goods. Under the Consumer Protection Act 1987 we must test all goods prior to the sale. The cost will be debited from the vendor’s account. Goods may be modified by an electrician.
<p>Contra of Charges & Payments. The vendor authorises Goldings to deduct commission and expenses at the stated rates from the hammer price and acknowledges Goldings right to retain any premium payable by the purchaser.
<p>Goldings disclaim responsibility for default by the buyer and therefore do not pay out the vendor until payment is received from the buyer.
<p>Subject to the foregoing Goldings will make Settlement of Account by cheque approximately 7 working days following the sale, unless other arrangements have been made.
<p>Net sale accounts under £3 will have a nil balance payable.
<p>Governing Law Terms and conditions and any matter relating to this WebSite shall be governed by and construed in accordance with the laws of England and Wales and any disputes arising shall be subject to the exclusive jurisdiction of the English Courts.
