Partly-printed war-dated DS as president, one page, 8 x 10, December 30, 1861. President Lincoln orders the Secretary of State “to affix the Seal of the United States to a Warrant for the pardon of Jack Shepherd, alias John Fisher.” Signed at the conclusion in black ink, “Abraham Lincoln.” In very good condition, with tape repair on reverse of a horizontal fold through Lincoln’s signature, mild toning to horizontal folds, lightly affecting signature, scattered creasing and wrinkling, and a bit of light soiling.
Prior to the sixteenth president only four people had been pardoned by a chief executive—out of a limited concept of presidential power but also rooted in a concern of interfering with judicial process. Lincoln, as a former attorney, clearly understood such a dilemma but found something in the case of Mr. Shepherd to make an exception. Perhaps a coincidence, or perhaps a bit of legal research, but on this same day, Lincoln referred to two copies of the US Constitution stored at the Library of Congress. A desirable Lincoln decree.
