Partly-printed DS, signed “A. Lincoln,” one page, 8.25 x 6, December 10, 1858. Surety bond for the case between Henry Stoddard and Sylvester Ball. In full: “I do enter myself security for costs in this cause and promise to pay all costs which may accrue to the opposite party in this action, or to any of the officers of this court; and in default of payment by the plaintiff of any costs ordered or adjudged to be paid by the plaintiff hereby agree and stipulate that execution may issue against my property for any costs taxed against said plaintiff.” In very good to fine condition, with repaired crease to top left corner, tape repairs on reverse of central horizontal fold, a mild shade of toning, and a bit of edge discoloration. Lincoln’s signature is exceptionally strong and bold, and this document would display beautifully.
This case stemmed from the distribution of proceeds of an 1851 sale of land in St. Louis. Ball had defaulted on a $10,000 bond to Stoddard, at which point the latter hired to law firm of Lincoln and Herndon to obtain the money as well as damages. Both parties, perhaps through some persuasive argument of the future sixteenth president, eventually reached a settlement and Stoddard dropped his case. Having lost the race for a US Senate seat from Illinois just a month before this document was signed, Lincoln returned to handling cases such as this, although his reputation as a debater had already started to spread. Most Lincoln legal documents are signed “Lincoln & [co-counsel]” or “[co-counsel] & Lincoln.” This one, signed solely as himself, is rare and highly desirable.
