<B>Abraham Lincoln. Unsigned Autograph Document.</B></I> Champaign Co., Ill., no date, one page, folio. John T. Rankin, co-defendant of James Wiley in a suit brought by John P. White, swears that ever since process was served on him "<I>he has…intended to defend said suit…On Monday the first day of this term he came in town for the purpose of making said defence, but waiting till near night, he left for home, the Judge not having arrived;…on Tuesday he made arrangement for a conveyance to town, in which he was disappointed, and…prevented from reaching town until about one or two o'clock P.M. when he found a default had been entered against him…</B></I>" As to "<I>non-completion of the house within the time mentioned in the contract, he expects to show that that was caused by the plaintiff's own fault, and that said house is now about completed; and as to not making the deed…the same was delayed only because the ground was not properly surveyed into town lots and recorded…before which the holder of the legal title was fearful to make a deed because of some statutory penalty…</B></I>" He declares the plaintiff has suffered no injury because of the lack of a deed and that the defendants are "<I>ready and willing to have a deed made to said plaintiff, conveying…complete legal title to said ground.</B></I>" An unusual document that highlights the purely logistical difficulties which sometimes plagued attendance at pioneer courts.
