<B>Abraham Lincoln. Document Signed "<I>…& Lincoln p.q.</B></I>",</B></I> with a brief docket on verso ("<I>Jones vs Maus / Replication</B></I>") also in his hand. No place (Tazewell Co., Ill.), April 1851, one page, folio. In Edward Jones vs Joseph S. Maus, the plaintiff declares that he "ought not to be barred from having and maintaining" his suit against the defendant. This suit was an action for trespass <I>vi et armis</B></I> --with force and arms - in which Jones, himself an attorney, sought $5000 damages for loss of an eye in a fight with Dr. Maus (the two men clashed because Jones called Maus a liar for claiming to be a graduate of the prestigious Jefferson Medical College in Pennsylvania). Maus claimed he had fought in self-defense, and each party claimed that the other had used a weapon and not just his fists. By means now unknown, the two men were persuaded to an agreement and in April 1852 Judge David Davis ordered the case dismissed. (For the record, subsequent research suggests that Dr. Maus was a liar and in fact never graduated from Jefferson Medical College). This document was first signed in the name of attorney William B. Parker, presumably in his own hand; to this, the future President has added "<I>& Lincoln p.q.</B></I>" Lincoln's signature is a trifle scratchy in appearance, and his "p.q." somewhat blotted, both due to the writing materials and to hasty folding of the document while the ink was wet.
