Lister, a suit involving 200 acres of land, Joseph Gwyn "<I>claims a part of the property attached in the case, or a certain interest therein…by virtue of a purchase from the defendant…and his title bond therefor recorded before any certificate of the levy of…attachment…was filed…</B></I>", and also that the plaintiff "<I>had both actual and constructive notice</B></I>" of this purchase prior to filing his levy.
