In part, "...Thomas Lewis, Administrator of the estate of Singleton Keeling, plantiff, complains of Preston Breckinridge, Executor of the Last Will and Testament of Lewis Keeling, deceased, defendent...said Lewis Keeling, in his lifetime...was indebted to the estate of the said Singleton Keeling, in the sum of five thousand dollars...the said Lewis Keeling, had and received...and in the further sum of one thousand dollars, for interest due...and being so indebted, the said Lewis Keeling departed...and the defendent herein became his Executor, and the plaintiff, having been only appointed the Administrator of the estate of said Singleton Keeling, in consideration of the premises aforesaid, the defendent undertook, and faithfully promised the plaintiff to pay him the sums of money aforesaid...Yet the said defendent (although often requested to do so) has not as yet paid the said sums of money, or any part thereof..."
