The highest bidder for any lot shall be the purchaser subject to a reserve price (if any) being reached, and the Auctioneers reserve the right to refuse the bid of any person without giving reason therefore.
Should any dispute arise between two or more approved bidders, or between the Auctioneers and any approved bidder, the lot or lots in dispute shall be offered again or not at the discretion of the Auctioneers and their decision shall be final.
The right is reserved to the vendor to bid by himself or his agent or to fix a reserve price. Any such price must be in the Auctioneers hands in writing not later than one hour before the sale commences. The Auctioneers will not hold themselves responsible for any reserve price given verbally, nor for the price realised of any lot or lots sold without reserve.
No person shall advance a less sum at each bidding than shall be mentioned by the Auctioneers at the time of sale, nor be allowed to retract a bidding.
The purchaser shall give his name and place of abode and pay the full purchase money for each lot or lots (at the fall of a hammer if required) in default of which the lot or lots so purchased may immediately be put up again and resold the purchaser in the first instance being liable for any loss on such resale.
The Auctioneers reserve the right to sell in such order and manner as they decide and to withdraw any lot prior to or at the start of sale.
No lot or lots shall be removed from the Auctioneers premises until paid for, and a delivery slip obtained from the Auctioneers Clerk, but each and every lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk of the purchaser thereof and shall be removed at the purchasers expense not later 4pm on the Friday following the sale. Neither shall any undertaking of the Auctioneers or their servants to take charge of any lots after the sale or to forward them to their destination be held to impose upon the Auctioneers any legal or equitable liability or obligation.
In as much as the Auctioneers act only as agents for the Vendor, they shall not be personally responsible for any default on the part of the Vendor.
Mechanical and electrical lots, statements in the catalogue as lots being 'in working order' are made at the sole responsibility of the Vendor and will in no way constitute a warranty or guarantee by the Auctioneers as to the truth of such statement.
If any purchaser shall neglect to fail to comply with the above conditions, the lot or lots shall be re-sold, either by public auction or private contract or otherwise disposed of in any way, whether or not notice be given to the defaulting purchaser, at the discretion of the Auctioneers: and the deficiency (if any) incurred by such second sale of disposal together with all charges and expenses attending the same, shall be made good by the defaulting purchaser at the present sale, and be recoverable from him as liquidated damages.
LASTLY - The auctioneers to be the sole arbitrators in every matter of dispute and their decision shall be final.
