Infinit International Auction Terms and Conditions
1. Item Condition and Buyer Acknowledgment
All lots are sold in their present condition, inclusive of any apparent or hidden imperfections. Once bidding concludes or a lot is declared sold, the transaction is considered final. Returns, cancellations, or exchanges are strictly not permitted.
Infinit International and its consignors (if applicable) do not provide any guarantees—express or implied—including suitability for any specific purpose or adherence to any legal standards. Any catalog entries, photos, or verbal comments are shared as professional insights and are not to be interpreted as factual warranties on age, authorship, condition, or authenticity.
Buyers are encouraged to inspect items or arrange for third-party review in advance. Placing a bid confirms your agreement to the lot’s condition and these terms. If you are uncertain about the legitimacy or integrity of an item, do not bid.
2. Estimates and Descriptions
Any listed values or appraisals are intended solely for general guidance. They do not assure actual resale worth, insurance coverage, or fair market pricing. Infinit International disclaims any responsibility for omissions or inaccuracies in written or spoken item information.
Third-party assessments or value discrepancies will not justify cancellations or refunds. All physical descriptions are approximate and should be independently verified when accuracy is essential to the bidder.
3. Liability Limitations
Infinit International’s total liability, under any situation, is limited to the amount paid by the successful buyer. The company is not liable for any indirect, incidental, or consequential loss—including, without limitation, lost revenue, replacement cost, or downstream claims—from auction involvement or resulting transactions.
4. Bidding Guidelines and Authority
The successful purchaser is the individual whose bid is validated and accepted by Infinit International. In the event of contested bids or miscommunication, we reserve full authority to:
Declare the legitimate buyer;
Resume bidding if needed;
Nullify erroneous sales;
Deny any participant’s bid without prior notice.
We allow online, phone, or email bidding with prior approval. Proof of identity and creditworthiness may be requested.
5. Bidder Obligations
Each bidder is solely accountable for bids placed through their registered account. Claims of unauthorized bidding or accidental submissions will not be honored. Agents bidding for organizations are personally liable unless otherwise arranged.
All submitted bids are non-reversible, enforceable, and final.
6. Purchase Charges
In addition to the final auction price (hammer price), buyers agree to cover:
An 5% non-refundable buyer’s commission;
All regional and local sales taxes, unless exempt with valid certification;
Delivery charges, import taxes, handling fees, or special packaging when necessary.
These components together form the Total Purchase Sum, which must be fully remitted by the due date on the invoice.
7. Confidential Reserves and Internal Bidding
Many auctioned items are subject to internal minimum prices (reserves), not visible to the public. Infinit International may place bids on behalf of the consignor to help reach the minimum.
Should active bids fall short of the internal reserve, we may elect to:
Finalize the sale anyway;
Reopen bidding;
Withdraw the item without prior notice.
8. Payment Instructions
We accept the following forms of payment:

Invoices will be issued within one business day post-sale. Late or partial payments will incur 15% annual interest. Shipments may be postponed until payment is confirmed in full.
Returns, when approved as exceptions, incur a 15% service fee, calculated from the lot’s hammer price. The commission and delivery charges are not refundable under any circumstances.
9. Unauthorized Disputes and Chargebacks
All buyers must resolve disputes exclusively through our internal process. Initiating a credit card chargeback or third-party dispute process will be considered a breach of agreement.
Should a chargeback occur, the buyer agrees to:
Compensate Infinit International with a $300 administrative fee plus any legal expenses;
Allow their account to be flagged or reported to credit and collections networks;
Be disqualified from any future transactions.
10. Breach and Enforcement
Failure to pay on time constitutes a default. Remedies may include:
A 15% default penalty applied to the hammer price;
Cancellation and resale of the lot, with damages pursued for any shortfall;
Prohibition from future auctions;
Debt collection via legal, financial, or property seizure methods;
Withholding of other items belonging to the buyer held by Infinit International.
Costs arising from enforcement, including legal and operational expenses, will be the buyer’s responsibility.
11. Delivery and Shipping
All orders are handled through Infinit International’s logistics team. Pick-ups in person are not supported for security and operational reasons.
Shipping fees are quoted post-sale. Customs delays, local taxation (e.g., VAT), and courier-related fees are the responsibility of the buyer. Risk transfers to the buyer upon shipment. Insurance is optional and should be arranged before payment.
12. Arbitration for Disputes
Disagreements between parties will be settled via binding arbitration in the jurisdiction where Infinit International is headquartered. Both parties forgo the right to courtroom litigation or class actions.
The arbitrator’s final ruling shall be enforceable. The non-prevailing party covers arbitration costs, including filing and representation fees.
13. Legal Release and Buyer Risk Assumption
By participating, the bidder releases Infinit International and its consignors from any legal claims, known or unknown. Buyers agree to assume full legal and financial responsibility for:
Compliance with local import laws;
Product use or misuse;
Losses resulting from misinterpretation or assumption.
14. Legal Framework and Clause Independence
Should any section of these terms be found invalid by law, the remainder will remain in effect. This agreement is governed by California state law.
