<p><b>CONDITIONS OF SALE</b>
<p>1. The highest Bidder shall be the Purchaser, and if any dispute arises during the sale, then the Auctioneer may, at his
discretion, put the lot up again; the Auctioneer’s decision to be final.
<p>2. The Auctioneer has the right to refuse any bid and to advance the bidding at his absolute discretion.
<p>3. All lots offered for sale may be subject to a protective reserve placed on the lot by the Vendor in agreement with Waddington’s. The Auctioneer reserves the right to bid, or direct an employee to bid, on the Vendor’s behalf, for goods subject to a reserve or at the Auctioneer’s discretion.
<p>4. Waddington’s have the right to withdraw or divide any lot or to combine any two or more lots at their sole discretion.
<p>5. Immediately the lot is sold, the Buyer shall forthwith give his name and permanent address and, if required, pay down the whole or any part of the purchase money; if he fails to do so, the lot or lots may, at the Auctioneer’s absolute discretion, be put up again and resold.
<p>6. Each and every lot is sold by the Vendor with all faults and defects and with all errors of description and is to be taken and paid for whether genuine and authentic or not and no compensation shall be paid for same.
<p>7. Notwithstanding the previous condition of sale, if within 14 days after the sale of the lot, the purchaser gives notice in
writing to Waddington’s that the lot sold is a deliberate forgery and within 7 days after such notification, the buyer returns the same to Waddington’s in the same condition as at the time of sale and satisfies Waddington’s that, considered in the light of the entry in the Catalogue, the lot is a deliberate forgery, then the sale of the lot will be rescinded and the purchase price of the same refunded.
<p>8. To prevent inaccuracy in delivery and inconvenience to the Portering staff, no lot can be taken away during the times of sale, nor can any lot be taken away unless it has first been paid for in full.
<p>9. All lots are to be paid for and taken away at the Purchaser’s expense within 48 hours of the date of sale.
<p>10. On the failure of the Buyer to take away and pay for any lot in accordance with Condition No. 8, Waddington’s, as agents of the Vendor, shall be entitled at their absolute discretion to re-sell the lot in question without notice to the Buyer, the expenses in connection with the same being the responsibility of the original Buyer. Notwithstanding the above condition of sale, at the fall of the hammer the Purchaser shall be responsible for the lot and Waddington’s will not accept any responsibility for any item which is lost, stolen, damaged or destroyed.
<p>11. Waddington’s reserve the right to refuse any bid or withdraw any lots from the sale without previous notice.
<p>12. Waddington’s are not to be held responsible in any matter connected with the commissioning of their staff to buy or bid for any lots in the sale. Reserves and commissions sent by telephone are accepted only at the sender’s risk and must be confirmed by letter or fax.
<p>13. In the event of any failure of the Buyer to comply with any of the above conditions, the damages recovered from the defaulter shall include any loss arising on any sale or resale of the lot together with the charges and expenses in respect to both sales.
<p>14. Waddington’s will not be responsible for any damage, however caused, to any lot packed and/or shipped by them after such lot leaves their premises.
<p><b>THIRD PARTY LIABILITY</b>
<p>Any person on Waddington’s premises, before, during or after the sale, shall deem to be there at his own risk and he shall have no claim against Waddington’s in respect of any injury he may sustain or any accident which may occur.
