CONDITIONS OF SALE
1. The highest accepted bidder for any lot shall be the purchaser and if any dispute shall arise between two or more persons the lot in dispute shall be put up again and re-sold or the Auctioneers may determine the dispute and declare the purchaser. The Auctioneers act as Agents only and reserve the right to refuse the bid of any person as they deem it advisable without being called upon to give a reason for such action, combine any two or more lots, divide any lot and to withdraw any lot or lots from the sale without in any case giving any reason.
2. No lot or lots shall be removed from the premises until paid for but each and every lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk of the respective purchaser of purchasers and shall be removed from the sale at the purchaser’s expense and taken with all faults and error of description.
3. All lots are put up for sale subject (a) to any reserve price imposed by the seller, or (b) to the right of the seller to bid either personally or else by any one person, who may be the Auctioneer.
4. No person at any bidding shall advance less that the sum stated by the Auctioneer at the time of selling nor shall any bidding be retracted.
5. All conditions and warranties as to the condition, quality, description, or fitness for any purpose whatsoever of any lot sold by the Auctioneer are hereby expressly excluded. Neither the Auctioneer nor the Seller will be bound by or liable for any loss or damage whether caused by negligence or otherwise of either or both or of their servants or agents and without prejudice to the generality of the foregoing neither the Auctioneer nor the Seller shall be liable for any loss of profit, business or production or similar or other loss whether direct or indirect or consequential, however caused.
6. Each purchaser shall give his or her name and address in writing and pay the full purchase money at the close of the Sale or if required, the whole or part of the purchase money, as required by the Auctioneers, during the course of the Sale. All statements made are the responsibility of the Vendor and the Auctioneers can take no personal responsibility for the accuracy of such statements.
7. The title to any lot shall remain to the Seller until the full sale price and any storage and interest charges have been paid to the Auctioneer, but the risk of damage to or loss of the lot by whatsoever cause and in whatsoever circumstances shall be transferred to the buyer upon sale.
8. The Auctioneer warrants that he will only sell lots which he believes to be owned by the Seller or to which the Seller will be able to pass a good title but should it transpire that the Seller’s title to any lot is defective or that the Seller cannot pass a good title to the buyer, the Auctioneer shall be under no obligation to the buyer, other than to use his best reasonable endeavours (short of litigation) to procure the transfer of a good title to the buyer and to assist the buyer in exercising any remedies that he may have against the Seller.
9. In the circumstances any potential buyer should rely solely and exclusively upon his own inspection of any lot and should not treat statements made in sale particulars or before or during the auction by the Seller or Auctioneer either as representations or to be relied upon.
N.B. – A sale by auction is not a consumer sale. Sale of Goods Act 1983 Section 55 (7) and Unfair Contract Terms Act 1977 Section 12 (2). No Vehicle is warranted or held out to be roadworthy and no lot is warranted or held out to be merchantable or safe for use or complying with statutory requirements for use, display or movement. The Auctioneer, his servants and agents have no authority to make representations.
10. If a buyer is permitted to take possession of any lot before the full sale price has been paid the Seller and/or Auctioneer shall be entitled to enter upon any premises of the buyer or under his control in order to repossess such lot.
11. If, before title passes to the buyer under these Conditions, the buyer nevertheless purports to resell or otherwise dispose of the lot any interest therein, the buyer shall hold the proceeds of such sale or other disposition upon trust for the Auctioneer and Seller jointly until title passes to the buyer under these Conditions, if at all, and in the meantime the Auctioneer and the Seller jointly until title passes to the buyer under these Condition, if at all, and in the meantime the buyer shall not deal with, charge or dispose of such proceeds except with the w written consent of the Seller or the Auctioneer.
12. Health and Safety at Work Act 1974. The goods are not sold as articles for use at work; they are sold on the understanding that the vendor does not represent them as being in a condition which makes them suitable for use at work. The purchases is reminded that if, nevertheless, any of the goods or articles purchased are intended by him to be supplied in due course for use at work, the purchaser shall, before so supplying them for such use, take such steps as are necessary to ensure, so far as is reasonably practicable, that such goods or articles will be safe and without risks to health when properly used and should carry out or arrange the carrying out of such testing and examination as may be necessary to enable him to carry out the obligations required by the Health and Safety at Work Act 1974.
13. If these conditions are fulfilled, the Vendor shall have the power to resell the lots, retaining any surplus and charging any deficiency and expense to the defaulter.
14. Lot money will be charged at the rate of 10% on each lot, VAT at the rate of 17.5% is payable on the 10%.
15. Collection Items should be collected by 5.00p.m. the day following the sale, unless by prior arrangement with the Auctioneers. Any items not removed within an agreed time will be charged storage at a rate of £5 per item per week or part of a week thereof, being payable in cash upon collection.
16. NOTE A.F. – All Faults– Such items were in some way damaged or imperfect at the time of preparing the catalogue.
17. NOTE Although an item MAY NOT BE MARKED A.F.. no warranty is given or intended that the article is NOT DAMAGED or imperfect and purchasers must make their own inspection in accordance with the conditions of sale.
18. Payment is accepted by cheque within the limits of any guarantee cards, cash and bankers draft.
19. At present we are unable to accept payment by Credit Cards - (this will be available for the next sale).
