Special Terms 1 - TERMS AND CONDITIONS OF THE AUCTION By registering to bid or placing a bid you agree to be bound by all of these terms & conditions and any other announced terms and conditions of sale or rules of the site. High and low estimates are provided solely for the convenience of the Buyer and White Water Coins & Currency makes no warranties of any kind relating to them as many items are under consignment. All lots are sold “AS-IS” condition and all sales are final. All Internet Bidders agree to pay a buyer’s premium equal to fifteen Percent (15%) of the hammer price of each item they purchase. Payment of the winning bid amount, buyer’s premium and shipping/handling charge will be made at the time the auction is reconciled by Seller using PayPal. Seller guarantees all coins & paper currency to be genuine. Coin grading is a subjective description in the opinion of the cataloguer or third party grading service. It is the bidder’s responsibility to determine condition and value of the coin or lot. We DO NOT guarantee coin grades on any of our lots. It remains your obligation to determine the value and grade of any item up for auction. I may be reached at 8080-366-3273 prior to or even during the auction. If specific views not listed in our photos are requested, we will take and post additional pictures to validate your concerns.
Any description offered, referring to coin grade or condition is completely the subjective opinion of White Water or the one referencing a coins grade or condition and Seller makes no express or implied warranties based on the subjective descriptions of any coins being sold. Placing a bid on an item has placed the Buyer in a legally binding obligation.

Special Terms 2 – If for any reason you have not paid in full for your items after 10 days of auction closing, your name will be submitted to I-Collector as an non-paying buyer. Sanctions against you by ProxiBid will be determined by others. However if after a 2nd notice you have not made payment in full to The Seller, you will be blocked from bidding on any White Water Coins and Currency future auctions. Seller will then place the unpaid item back into inventory for sale at another upcoming event.
Special Terms 2.1 – If you do not have an Email on file with I-Collector, you will have only 5 days after the completion of said auction to make payment in full before your item is placed back in inventory and you will be reported to I-Collector as being a non-compliant Bidder and blocked from bidding on any White Water Coins and Currency future auctions. Seller will then place the unpaid item back into inventory for sale at another upcoming event.

3. BUYER OBLIGATIONS
3.1 Payment to Seller. Placing a bid in an auction-style event, making an offer through the Make an Offer process, or committing to buy an item through the Buy Now process is a legally binding obligation. If you are the successful Buyer, you agree to pay the amount of your bid plus all applicable taxes and charges in the time and manner designated by the Seller. Failure to make such payment shall be deemed a breach of this Agreement. (Any and all references to the Buyers Obligations are cropped from the I-Collector Unified Users Agreement. The item number referenced shows the location of that cropping.)
3.2 Payment to I-Collector. The parties acknowledge and agree that I-Collector is paid a percentage, to be solely determined by I-Collector based on the event, of any successful bid/purchase utilizing the I-Collector Services (the " I-Collector Premium"), and the Seller incorporates such I-Collector Premium into the total purchase price due from the successful Buyer. Buyer acknowledges and agrees that its payment of the I-Collector Premium to I-Collector is in consideration for Buyer's use of the I-Collector Services to become the successful buyer and such payment obligation is not contingent upon the consummation of the sale transaction between Buyer and Seller. Accordingly, notwithstanding and without limiting Buyer's payment obligation to Seller set forth in Section 3.1 above or Section 5 below (or the Seller's Special Terms), in the event for any reason the transaction between the Buyer and the Seller is not consummated or the Buyer otherwise does not make payment of the total purchase price owed to Seller with respect to the successful bid/purchase offer, within fifteen (15) days of the date of the bid/purchase offer, the successful Buyer agrees to pay the I-Collector Premium directly to I-Collector. Any default in payment will be subject to interest and collection fees as set forth under Section 27 below.
Special Terms 3 – Returns of items found not agreeable to the Buyer is permitted within 10days of our shipping the item to you for valid reason. Valid reasons are identified in section “SNAD” above. Refunds less any unpaid shipping or handling expenses (if any) shall be made in the same manner as the Buyers payment was received. Buyer agrees in advance not to file the “dispute payment” function with any payment agency at any time unless “SNAD” has first been exercised and exhausted by Seller and I-Collector through arbitration as identified in section 6. DISPUTES BETWEEN BUYERS AND SELLERS. All sections and sub-sections of this provision are clearly stated in the I-Collector Unified Users Agreement and are in full operation. Any disputes about shipping or handling expenses shall be filed as an unpaid amount due the Seller until all payments deemed by the Seller as due and payable shall be made. Please note highlighted section on DISPUTE RESOLUTION. Seller agrees that in its own discretion to apply a Good Faith effort in every case to solve a Buyers concerns without having to resort to a filed claim to I-Collector.
Selling outside the United States - Sellers who ship internationally and those who sell items manufactured outside of the United States should regularly review current information regarding Banned Parties on the OFAC website. Because this Seller chooses not to review and keep up with current information on selling outside the United States, in order to remain compliant to I-Collector, this Seller has chosen not to complete a sell to any Buyer who requests his bid item to be shipped outside the United States. Although the banned list of countries that I-Collector chooses with which not to do business differs from this Sellers, our policy remains as stated above. Outside the United States includes Canada and any other country that requires additional paperwork, forms or fees. The Buyer must have a delivery address within the 50 United States. The delivery address may not be a Post Office Box. Since we do not know when The Buyer is bidding whether or not you (The Buyer) are located in the United States or not, This Sellers policy is to simply refund the payment made through PayPal. We do apologize in advance if this causes you any inconvenience. If we (The Seller) have an Email address on file for you, we will contact you first to verify that you either do or do not have a mailing address in the United States allowing for the delivery, otherwise a reimbursement will be made. Usually this may take 3-4days to sort out.
Limited Liability - Under no condition for punitive or other reasons of actual or extended liability, at no time may a liability or claimed damage extend beyond the actual bid price of any item(s). Because certain jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, this Sellers liability in such jurisdictions shall be limited to the extent permitted by law but still shall not exceed the bid price of any particular item won. It is your statement that by bidding on this Sellers site that you are in fact in agreement with this stated policy and its intended application for both your (The Buyer) and our (The Seller)’s protection.
AMENDMENT OF TERMS AND CONDITIONS – This Seller has the right to amend this Agreement at any time. Any amendment will be accomplished by updating the pages you are looking at now. Please visit this page periodically in order to monitor any changes that may have been made to this Agreement, particularly before you participate in an event. Every time you use this website, you are agreeing to the Unified User Agreement as well as This Sellers Terms as it exists at that time. In the event of any material amendment to the User Agreement which would adversely impact your rights or obligations hereunder, you will be required to affirmatively accept the amended User Agreement in order to continue to bidding in This Sellers Auction. You do this by bidding on our auction pages.
YOU (The Buyer) ARE IN AGREEMENT - By bidding on our site, you are making your irrevocable statement that you are in agreement with our stated Policy and Terms and will abide by these written details, stipulations and conditions.
