Shipping Responsibility: The auction organizers/sellers are not responsible for shipping any items. The buyer must arrange for shipping, pickup, or delivery of purchased items at their own expense.
Pickup Deadline: Buyers must collect their items from the Elbert County Fairgrounds by June 8, 2025, 2:00 PM MST. If the buyer cannot arrange for pickup by that time, arrangements can be made for storage near Kiowa, CO, until June 16, 2025. (Reminder - Purchaser assumes complete responsibility for items at the time the Auctioneer says “Sold”). Arrangements for storage between June 8 and June 16 must be made both verbally AND in writing with Lance Nichols of Nichols Auctioneers. Failure to do so may result in storage fees or forfeiture of the item. If items remain after June 16th, 2025, Nichols Auctioneers will have the option of reselling, removing, or storing at an additional expense and risk of the buyer.
Payment Details:
Winning online bidders will receive an invoice to the email address registered with Live Auction Group after the conclusion of the sale. (Check your junk and spam folders). Contact Nichols Auctioneers if you have not received an invoice within 24 hours after the conclusion of the sale.
The winning bidder will pay an additional 5% buyer’s premium on all items purchased online. This is in addition to the 4% buyer’s premium for credit cards and/or wire transfer fees.
Online buyer payment methods accepted are wire transfers ($20 domestic transfer fee, $30 international transfer fee), or debit/credit card payment (additional 4% buyer’s premium).
Payment must be received in full by Wednesday, June 11, 2025, at 1:00 P.M. Mountain Standard Time.
No items will be released until payment has been made in full.

AUCTION NOTICE
Bids are now being accepted online! Please read all terms and conditions related to all of our auctions, as well as those specific to online bidding and the Jim Ostrowski auction!
TERMS AND CONDITIONS OF SALE
1. IDENTIFICATION – All purchasers are required to have a buyer’s number to bid registering by full name and address, telephone number, method of payment and state or military issued photo I.D. (Driver's License, Passport, Military ID).
2. HIGHEST BIDDER – Please show your number to the Clerk after each purchase to eliminate possible error. The highest bidder shall be the purchaser and shall not retract his bid. Buyer agrees not to stop payment on checks. All sales are Final.
3. DISPUTE BETWEEN BIDDERS – If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute.
4. RESERVE – On lots upon which there is a reserve or minimum the seller reserves the right to bid via the Auctioneer. Unless stated otherwise, this is not an absolute auction and the seller reserves the right to place a minimum on any item.
5. TERMS OF SALE – Payment in full (including sales tax) is required by close of the auction, on auction date – nothing to be removed from premises before settlement. Any cost of collection, including attorney fees, shall be paid by the buyer. I grant NICHOLS AUCTIONEERS a security interest in this equipment until paid.
6. CONDITIONS OF SALE – AS IS – each lot is sold as is, where is – all sales final. NO guarantees or warranties are expressed or implied! No sale shall be adjusted or canceled by any reason of any discrepancies or inaccuracies in the description of any item or lot. Buyer warrants he has inspected all equipment and items for auction to their own satisfaction prior to bidding and buys accordingly. The auctioneer reserves the right to reject any and all bids.
7. RESPONSIBILITY – Purchaser assumes complete responsibility for items at time the Auctioneer says “Sold”.
8. CLAIMS – No claims will be allowed after goods are removed from premises.
9. RECORDS – The record of sale kept by the Auctioneer and Clerk will be taken as final in the event of any dispute.
10. PERSONAL AND PROPERTY RISK – Persons attending during exhibition, sale, or removal of goods assume all risks of damage of or loss to person or property and specifically release the auctioneer and seller from any liability. Nichols Auctioneers/Associates/Landowner or equipment owners/operators are not responsible for accidents, injury, or illness.
11. AGENCY – The Auctioneer is acting as agent only, and is not responsible for acts of its principals.
12. PLEASE NOTE – Your ACCEPTANCE of this buyer number means you have read and fully understand these terms and conditions and AGREE TO BE BOUND THEREBY.
13. BUYERS PREMIUM – There will be a 4% Buyer’s Premium charged if you choose to pay via credit or debit card. Additional buyer’s premiums may be charged depending on the sale. Announcements and signage at the beginning of the auction will state buyer’s premiums and terms. Ask questions BEFORE you bid. If a sale is offered to online bidders, there will be an additional buyer's premium if you are the winning bidder via the online platform. See online platform for details specific to each auction.
14. Nichols Auctioneers reserves the right to reject bids from anyone at any time, as deemed by sale management.
15. TITLED VEHICLES - Sellers will incur a $25 postage and handling fee per titled vehicle sold. All titles will be mailed to the winning bidder within 14 business days after the auction, no exceptions. If it is not stated that there is a title when the vehicle sells, assume there is no title.
16. Phone bids are offered as a courtesy and a service and we will do the best we can to contact you when the item(s) you're interested in sells. However, sometimes things happen, and we aren't able to make the call and we are often at a location where there is not a reliable cell signal. If the item(s) is offered online, but the buyer chooses to phone/absentee bid, the same online buyer’s premium WILL apply. It is ALWAYS best to send an agent to bid on your behalf. All verbal terms and conditions as stated at the beginning of the auction apply and everything is sold as is, where is, with no guarantees.
Please keep your buyer's card in your possession at all times during the auction - it is your "credit card" for this auction and you assume all responsibility for it.
