1864 Civil War United States Senate Amendment S. 41

“That when any person of African descent... shall be mustered into the military or naval service of the United States, his wife and children... shall forever thereafter be free...”
March 15, 1864-Dated Civil War Period, U.S. Senate Amendment S. 41, ‘Intended to be proposed by Mr. Wilson to the Bill (S. 41), “To promote enlistments in the army of the United States, and for other purposes,’...” Very Good.
Original Printed Act of the U.S. Senate Amendment S. 41, measures 11” x 6.75,” 1 sheet with 2 pages being printed face and back. This rare Bill two tiny central holes just above the word AMENDMENT where this Bill was possibly pulled from a file, and it has scattered tone and staining mostly across the central portions of the document, trimmed. This extremely important printed Amendment states that any African-American already in service by any state, in part:

“That when any person of African descent... shall be mustered into the military or naval service of the United States, his wife and children, if any he have, shall forever thereafter be free, any law usage, or custom whatsoever to the contrary nonwithstanding.”

Therefore Blacks and/or Slaves of African decent serving in the Unites States Union military, either the Army or Navy, that person and his wife and children were to become forever FREE. This historic Amendment also made provision for compensation to the owner of the wife and children for loss of services. An extremely rare and important event in American Black history.
