<p>Unless amended by any posted notice during the sale, the following conditions of sale are the complete terms and conditions on which all property is offered for sale. The property is offered by West Coast Estates, as agent for the consignors, unless the catalogue indicates otherwise. By bidding at auction, whether present in person or by agent, by written bid, telephone, on the Internet or other means, the buyer agrees to be bound by these Conditions of Sale.
BUYERS DEEMED TO KNOW THESE CONDITIONS: All parties bidding at the sale shall be held to have informed themselves as to these conditions of sale.
<p>ALL BIDDERS TO REGISTER: Pre-registration is required to participate in this event. Any party bidding at the sale shall register their full name, address and other relevant information with the Auctioneer before the sale. Our services are available to individuals who can form legally binding contracts under applicable law. Our services are not available to minors. If you do not qualify please do not use our services. As part of our verification process you will be asked to supply credit card information as part of the registration process
LIMITED WARRANTY: All lots are sold "AS IS". West Coast Estates is happy to provide a condition report for any item included in the sale. However, West Coast Estates provides no expressed or implied warranty or representation as to the condition of any lot offered for sale, and no statement made at any time, whether oral or written, shall constitute such warranty or representation. Descriptions or conditions are not warranties. The descriptions of the conditions of articles in this catalogue, including all references to damages or repairs, are provided as a service to interested persons and do not negate this paragraph. Accordingly, all lots should be viewed by prospective buyers to evaluate the condition of the property offered for sale.
THE CONSIGNOR WARRENTS GOOD TITLE TO THE PURCHASER.
RESERVES, ABSENTEE BIDS & TELEPHONE BIDS: The Auctioneer reserves the right to withdraw any lot at any time before, and/or during the sale. Certain lots may be subject to reserve bids or absentee bids and the Auctioneer is not bound to sell any lot whatsoever to the highest bidder or any other bidder.
When bidders are unable to attend the sale, the auction house will be pleased to enter their absentee bids upon providing registration information. These bids should always be made or confirmed in writing by fax or e-mail such bids will be executed at the lowest price taking into account the reserve price and other bids. If two or more parties have entered matching bids, the first bid received shall take preference. The auctioneer may execute bids for absentee bidders directly from the podium. The execution of absentee bids by the auctioneer will be clearly identified.
Telephone bids will also be executed for absentee bidders who wish to participate in the auction. Arrangements for telephone bidding must be confirmed in advance with the office prior to the sale date at: 1.800.463.1195, or on the day of sale: 604.878.0489. The staff will execute telephone bids from designated areas in the salesroom.
Theodore Pappas III Auctioneer and West Coast Estates assume no responsibility for failure to execute absentee bids or telephone bids on behalf of the prospective buyer for any reason whatsoever.
<p>The limit you indicate on your absentee bid or telephone bid is for the hammer price exclusively. Please keep in mind that a Buyers Premium of 20% will be added to the price of each lot you buy and is payable along with any applicable taxes.
<p>CONDUCT OF AUCTION: The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to reject any bid, to advance the bidding at his absolute discretion and in the event of any dispute between bidders to determine the successful bidder, to continue the bidding or to re-offer and resell the lot in dispute.
AUCTIONEER TO DETERMINE ALL DISPUTES: All matters of dispute must be immediately submitted To The Auctioneer.
COMPLETION OF SALE: Subject to any dispute, the lot shall be deemed to have been sold and delivered when the Auctioneer has moved on to the next lot and opened bidding.
REMOVAL OF GOODS: Immediately on having been sold, all lots are held to be delivered and remain at the purchaser’s own risk. Upon the sale the purchaser assumes full risk and responsibility for the lot.
West Coast Estates may, in their discretion and as a service to buyers, arrange to have purchased lots packed, insured and forwarded at the request, expense and risk of the buyer. West Coast Estates assumes no responsibility for acts or omissions in such packing or shipping by their respective employees and/or other packers or carriers, whether or not recommended by West Coast Estates

<p>TERMS OF PAYMENT: ALL BIDS EXECUTED IN CANADIAN DOLLARS Upon sale the purchaser must pay the full purchase price to the Auctioneer. Unless otherwise arranged, the purchaser must remove the lot from the premises on the day of the sale. Before removal, all lots must be paid for by cash, approved cheque, or credit card (Mastercard or Visa). There are no terms.
The Auctioneer reserves the right to hold any lot until the cheque tendered in payment of said lot has been cleared by the bank and/or approved to the satisfaction of the Auctioneer.

REPRODUCTION PHOTOGRAPHICALLY AND TO REPORT PRICES: West Coast Estates reserves the right to publish any or all prices realized and to reproduce photographically, or permit others to reproduce photographically, any items which West Coast Estates has photographed and/or received for auction.

<p>EXPORTATION PERMITS
Certain property sold at auction may be subject to the provisions of the endangered species act, the marine mammal protection act or the migratory bird act. In order to export these items, special licenses must be obtained from the Canadian & U.S. Fish & Wildlife office. Some items may not be exported, to the U.S.A. or other countries at all.
<p>West Coast Estates Auctions is willing to attempt to obtain such licenses on behalf of the purchaser for a fee of $125.00 US per license. However there are no assurances that any license can be obtained, please contact West Coast Estates Auctions should you have any questions.
